    Article 35 must also be applied to reflect the practical realities of the applicant's position in order to ensure the effective protection of the rights and freedoms guaranteed by the Convention (Hilal v. the United Kingdom (dec.), no. 45276/99, 8 February 2000).

    These standards imply that the ill-treatment the applicant alleges he will face if returned must attain a minimum level of severity if it is to fall within the scope of Article 3. The assessment of this is relative, depending on all the circumstances of the case (Hilal v. the United Kingdom, no. 45276/99, § 60, ECHR 2001-II).

    The Court recalls that Article 3 does not, as such, preclude Contracting States from placing reliance on the existence of an internal flight alternative in their assessment of an individual's claim that a return to his country of origin would expose him to a real risk of being subjected to treatment proscribed by that provision (Salah Sheekh v. the Netherlands, no. 1948/04, § 141, ECHR 2007-I (extracts), Chahal v. the United Kingdom, 15 November 1996, § 98, Reports of Judgments and Decisions 1996-V and Hilal v. the United Kingdom, no. 45276/99, §§ 67 - 68, ECHR 2001-II).

    Dies ist immer dann anzunehmen, wenn diese Verhältnisse ganz oder überwiegend auf staatlichem Handeln, auf Handlungen von Parteien eines innerstaatlichen Konflikts oder auf Handlungen sonstiger, nicht staatlicher Akteure, die dem Staat zurechenbar sind, beruhen, weil er der Zivilbevölkerung keinen ausreichenden Schutz bieten kann oder will (EGMR, Urteile vom 28.06.2011 - 8319/07 und 11449/07 -, www.hudoc.echr.coe.int, Rn. 213, und vom 21.01.2011 - 30696/09 - , Rn. 249 ff.).

    Es sind also im Rahmen von § 60 Abs. 5 AufenthG i.V.m. Art. 3 EMRK nicht nur Gefahren für Leib und Leben berücksichtigungsfähig, die seitens eines Staates oder einer staatsähnlichen Organisation drohen, sondern auch "nichtstaatliche" Gefahren auf Grund prekärer Lebensbedingungen, wobei dies aber nur in ganz außergewöhnlichen Einzelfällen in Betracht kommt (EGMR, Urteile vom 28.06.2011 - 8319/07 und 11449/07 -, Rn. 278 ff., vom 21.01.2011 - 30696/09 - , Rn. 253 ff., und vom 27.05.2008 - 26565/05 - , Rn. 42; BVerwG, Beschluss vom 13.02.2019 - 1 B 2.19 -, juris Rn. 6, und Urteil vom 13.06.2013 - 10 C 15.12 -, juris Rn. 24 f.; VGH Bad.-Württ., Urteile vom 29.10.2019 - A 11 S 1203/19 -, juris Rn. 96, vom 26.06.2019 - A 11 S 2108/18 -, juris Rn. 26, und vom 24.07.2013 - A 11 S 697/13 -, Leitsatz 5 sowie insbesondere auch juris Rn. 79 ff.; Bay.     Ein außergewöhnlicher Fall im vorgenannten Sinne liegt nur bei einem sehr hohen Schädigungsniveau vor, in dem die humanitären Gründe entsprechend den Anforderungen des Art. 3 EMRK "zwingend" sind (VGH Bad.-Württ., Urteile vom 29.10.2019 - A 11 S 1203/19 -, juris Rn. 99, vom 26.06.2019 - A 11 S 2108/18 -, juris Rn. 36 ff.; vgl. EGMR, vom 28.06.2011 - 8319/07 und 11449/07 -, Rn. 278, 282 f.; BVerwG, Beschluss vom 13.02.2019 - 1 B 2.19 -, juris Rn. 6, und Urteil vom 31.01.2013 - 10 C 15.12 -, juris Rn. 25; vgl. auch Hess. VGH, Urteil vom 23.08.2019 - 7 A 2750/15.A -, juris Rn. 45; Nds. OVG, Urteil vom 29.01.2019 - 9 LB 93/18 -, juris Rn. 51; Bay. VGH, Urteil vom 21.11.2014 - 13a B 14.30284 -, juris Rn. 19).

    Die tatsächliche Gefahr einer Art. 3 EMRK zuwiderlaufenden Behandlung muss aufgrund aller Umstände des Falles hinreichend sicher und darf nicht hypothetisch sein (EGMR, Urteile vom 28.06.2011 - 8319/07 und 11449/07 -, Rn. 212 ff., vom 27.05.2008 - 26565/05 - , Rn. 34 ff., und vom 06.02.2011 - 44599/98 -, Rn. 36 ff.; vgl. auch OVG NRW, Urteil vom 18.06.2019 - 13 A 3930/18.A -, juris Rn. 43; Nds.     Insoweit sind die vorhersehbaren Folgen einer Rückkehr unter Berücksichtigung sowohl der allgemeinen Lage im Abschiebungszielstaat als auch der persönlichen Umstände des Ausländers zu prüfen (EGMR, Urteile vom 23.8.2016 - 59166/12 [J. K. and others v. Sweden] - HUDOC Rn. 83; vom 5.9.2013 - 61204/09 [I. v. Sweden] - HUDOC Rn. 56; vom 6.6.2013 - 2283/12 [Mohammed v. Austria] - HUDOC Rn. 95; vom 29.1.2013 - 60367/10 [S. H. H. v. The United Kingdom] - HUDOC Rn. 72; vom 28.6.2011 - 8319/07 und 11449/07 [Sufi and Elmi v. The United Kingdom] - HUDOC Rn. 216; hierzu bereits Senatsbeschluss vom 25.5.2018 - 9 LA 64/18 - juris Rn. 6).

    Eine allgemeine Situation der Gewalt im Abschiebungszielstaat kann für sich genommen nur in Fällen ganz extremer allgemeiner Gewalt (" in the most extreme cases of general violence ") eine Verletzung von Art. 3 EMRK durch eine Abschiebung nach sich ziehen, wenn die Gefahr einer Fehlbehandlung (" ill-treatment ") infolge des bloßen Umstands der Anwesenheit einer Person im Zielstaat besteht (" where there is a risk of ill-treatment simply by virtue of an individual being exposed to such violence on return ") (vgl. EGMR, Urteile vom 13.12.2016 - 41738/10 [Paposhvili v. Belgium] - HUDOC Rn. 86; vom 23.8.2016 - 59166/12 [J. K. and others v. Sweden] - HUDOC Rn. 53; vom 9.4.2013 - 70073/10 und 44539/11 [H. and B. v. The United Kingdom] - HUDOC Rn. 91 f.; vom 29.1.2013 - 60367/10 [S. H. H. v. The United Kingdom] - HUDOC Rn. 73 und 79; vom 28.6.2011 - 8319/07 und 11449/07 [Sufi and Elmi v. The United Kingdom] - HUDOC Rn. 218 und 241).

    Der für die Beurteilung der Gefahr einer Fehlbehandlung erforderliche Gefahrengrad bemisst sich bei bewaffneten Unruhen im Abschiebungszielstaat u. a. nach den Gefahren, die sich aus den (verbreiteten) Kampfmethoden der Konfliktparteien für die Zivilbevölkerung ergeben, der Intensität und Ausdehnung des Konflikts sowie schließlich der auf Grund der Kampfhandlungen getöteten, verletzten und vertriebenen Zivilpersonen (vgl. EGMR, Urteil vom 28.6.2011 - 8319/07 und 11449/07 [Sufi and Elmi v. The United Kingdom] - HUDOC Rn. 241; s. a. EGMR, Urteil vom 29.1.2013 - 60367/10 [S. H. H. v. The United Kingdom] - HUDOC Rn. 91; s. a. Nds. OVG, Urteil vom 26.1.2012 - 11 LB 97/11 - juris Rn. 55).

    Zwar haben die sozio-ökonomischen und humanitären Bedingungen im Abschiebungszielstaat weder notwendig noch einen ausschlaggebenden Einfluss auf die Frage, ob eine Person tatsächlich Gefahr läuft, im Aufnahmeland einer Art. 3 EMRK widersprechenden Behandlung ausgesetzt zu sein (vgl. EGMR, Urteile vom 29.1.2013 - 60367/10, [S. H. H. v. The United Kingdom] - HUDOC Rn. 74; vom 28.6.2011 - 8319/07 und 11449/07 [Sufi and Elmi v. The United Kingdom] - HUDOC Rn. 278; vom 20.1.2009 -32621/06 [F. H. v. Sweden] - HUDOC Rn. 92; vom 11.1.2007 - 1948/04 [Salah Sheekh v. The Netherlands] - HUDOC Rn. 141).

    Schlechte humanitäre Bedingungen im Abschiebungszielstaat, die ganz oder in erster Linie auf Armut oder auf fehlende staatliche Mittel zurückzuführen sind, um mit auf natürlichen Umständen beruhenden Gegebenheiten umzugehen, können aber in Anwendung des in einem solchen Fall maßgeblichen (vgl. EGMR, Urteil vom 28.6.2011- 8319/07 und 11449/07 [Sufi and Elmi v. The United Kingdom] - HUDOC Rn. 282), im Verfahren N. v. The United Kingdom entwickelten strengen Maßstabs in ganz besonderen Ausnahmefällen, in denen humanitäre Gründe zwingend gegen eine Abschiebung sprechen, zu einem Verstoß gegen Art. 3 EMRK führen (vgl. EGMR, Urteile vom 28.6.2011 - 8319/07 und 11449/07 [Sufi and Elmi v. The United Kingdom] - HUDOC Rn. 278; vom 29.1.2013 - 60367/10 [S. H. H. v. The United Kingdom] - HUDOC Rn. 75; siehe auch EGMR, Urteil vom 13.12.2016 - 41738/10 [Paposhvili v. Belgium] - HUDOC Rn. 183 zu solchen ganz besonderen Ausnahmefällen).

    Nur wenn die schlechten humanitären Verhältnisse im Abschiebungszielstaat primär auf direkte oder indirekte Handlungen oder Unterlassungen dortiger Konfliktparteien zurückzuführen sind, hält der Europäische Gerichtshof für Menschenrechte seinen im Verfahren M. S. S. v. Belgium and Greece (Urteil vom 21.1.2011 - 30696/06 - HUDOC) entwickelten und im Verfahren Sufi and Elmi v. The United Kingdom (Urteil vom 28.6.2011, - 8319/07 und 11449/07 - HUDOC Rn. 282 f.) auch im Hinblick auf die humanitären Bedingungen in Flüchtlingslagern in Süd- und Zentralsomalia angewandten weniger strengen Maßstab für besser geeignet, um einen Verstoß gegen Art. 3 EMRK festzustellen (vgl. EGMR, Urteil vom 29.1.2013 - 60367/10 [S. H. H. v. The United Kingdom] - HUDOC Rn. 77).

    Sowohl die Rechtsprechung des Europäischen Gerichtshofs für Menschenrechte (Urteil vom 28.6.2011 - 8319/07 und 11449/07 [Sufi and Elmi v. The United Kingdom] - HUDOC Rn. 278, 282 f.) als auch die des Bundesverwaltungsgerichts (Urteil vom 31.1.2013 - 10 C 15.12 - juris Rn. 23) machen deutlich, dass bei "nichtstaatlichen" Gefahren für Leib und Leben ein sehr hohes Schädigungsniveau erforderlich ist, da nur dann ein außergewöhnlicher Fall vorliegt, in dem etwa die humanitären Gründe entsprechend den Anforderungen des Art. 3 EMRK "zwingend" sind.

    In seiner Entscheidung vom 29. Januar 2013 (- 60357/10 [S. H. H. v. The United Kingdom] - HUDOC, Rn. 91) hat der Gerichtshof in Abgrenzung zu seinem Urteil vom 28. Juni 2011 (- 8319/07 und 11449/07 [Sufi and Elmi v. The United Kingdom] - HUDOC Rn. 212 - 219) herausgestellt, dass er nach den seinerzeit vorliegenden Erkenntnissen nicht zu dem Schluss kommen könne, dass die Lage in Afghanistan, auch wenn sie aufgrund des anhaltenden Konflikts sehr ernst sei, mit der in Süd- und Zentral-Somalia vergleichbar sei.

    In seiner Entscheidung vom 29. Januar 2013 (- 60357/10 [S. H. H. v. The United Kingdom] - HUDOC Rn. 91) hat der Europäische Gerichtshof für Menschenrechte in Abgrenzung zu seinem Urteil vom 28. Juni 2011 (- 8319/07 und 11449/07 [Sufi and Elmi v.
