35. In Art. 1 und 14 sieht die Konvention vor, dass die Vertragsstaaten "allen ihrer Hoheitsgewalt unterstehenden Personen" die in Abschnitt 1 dieser Konvention niedergelegten Rechte und Freiheiten "ohne Diskriminierung" gewährleisten (s. sinngemäß das Urteil Engel u.a. vom 8. Jedoch ist das Recht auf Zugang zum öffentlichen Dienst als solches nicht in der Konvention gewährleistet (siehe u.a. Kosiek, Urteil vom 28. August 1986, Série A Nr. 105, S. 20, Ziff. 34-35, EGMR-E 3, 265), und der Eingriff hindert ihn nicht daran, abgesehen von den aufgezeigten Folgen ein Privatleben nach den eigenen Wünschen zu führen.Daraus folgt jedoch nicht, dass Angehörige des öffentlichen Dienstes, einschließlich jener auf Probe, in anderer Hinsicht nicht dem Anwendungsbereich der Konvention und insbesondere dem Schutz des Art. 10 unterliegen (siehe die Urteile vom 28. August 1986, Glasenapp, Série A Nr. 104, S. 26, Ziff. 49-50, EGMR-E 3, 252, und Kosiek, Série A Nr. 105, S. 20, Ziff. 35-36, EGMR-E 3, 265).

Q. v. THE FEDERAL REPUBLIC OF GERMANY
The case is notably distinguishable from the Glasenapp and Kosiek cases (Applications Nos. 9228/80 and 9704/82 respectively) where the Commission considered that, on the facts of those cases, those applicants had been called upon "to express their opinions, make clear their attitudes and make a formal declaration of their allegiance to the Constitution", and that accordingly those cases came within the terms of Article 10 of the Convention.For the avoidance of doubt the Government still dispute the basis upon which the Commission declared the two above mentioned applications (Nos. 9228/80 and 9704/82) admissible, and do not consider that the issue arising in any of these three cases exceeds the boundaries of the question of access to the civil service, a right not guaranteed by the Convention.
In this respect the present case is to be distinguished from Application No. 9228/80 Glasenapp v. the Federal Republic of Germany and Application No. 9704/82 Kosiek v. the Federal Republic of Germany.
Where the operation of loyalty control impinges on an individual's freedom of expression an issue arises under Article 10 (Art. 10) of the Convention notwithstanding that the individual concerned is or would wish to be a civil servant (No. 9228/80 Comm. Report 11.5.84, paras. 67-77; No. 9704/82 Comm. Report 11.5.84, paras. 60-70).
This approach was specifically confirmed by the Court in its judgments in those two cases in which it declined the respondent Government's renewed invitation to find those applicants' complaints incompatible with the Convention (Glasenapp judgment of 28 August 1986, Series A no. 104, paras. 49-50; Kosiek judgment of 28 August 1986, Series A no. 105, paras. 35-36).

The Commission recalls that freedom of expression is one of the essential foundations of a democratic society (cf. Eur. Court H.R., Handyside judgment of 7 December 1976, Series A no. 24, p. 23, para. 49), and that the status of civil servant does not deprive a person of the protection afforded by Article 10 (Art. 10) of the Convention (Eur. Court H.R., Glasenapp judgment of 28 August 1986, Series A no. 104, p. 26, para. 50; Kosiek judgment of 28 August 1986, Series A no. 105, p. 20, para. 36).In this connection, the Commission recalls that "a duty of moderation, which is a widespread feature of the regulations of the civil services of member states of the Council of Europe, arises from the duties and responsibilities which civil servants have as agents through which the State operates..."
