    Denn entscheidend ist, ob die Rechtsunterworfenen in einer demokratischen Gesellschaft den Gerichten Vertrauen entgegenbringen ("Justice must not only be done, it must also be seen to be done", vgl. EGMR, Delcourt v. Belgium, Urteil vom 17. Januar 1970, Nr. 2689/65, Rn. 31; Oleksandr Volkov v. Ukraine, Urteil vom 9. Januar 2013, Nr. 21722/11, Rn. 106, der Sache nach jeweils aufgreifend High Court of Justice, R v Sussex Justices, ex parte McCarthy, [1924] 1 KB 256).

    Schließlich enthält auch die Europäische Menschenrechtskonvention keine Vorgabe für die Interaktion der Gewalten (EGMR , Kleyn and others v. The Netherlands, Urteil vom 6. Mai 2003, Nr. 39343/98 u.a., Rn. 193; EGMR, Sacilor Lormines v. France, Urteil vom 9. November 2006, Nr. 65411/01, Rn. 59, 71; Oleksandr Volkov v. Ukraine, Urteil vom 9. Januar 2013, Nr. 21722/11, Rn. 103).

    Erforderlich ist nach dessen Rechtsprechung vielmehr eine Prüfung anhand der Kriterien der Unabhängigkeit und Unparteilichkeit und unter Berücksichtigung der konkreten Gegebenheiten des Einzelfalls (EGMR, Ringeisen v. Austria, Urteil vom 16. Juli 1971, Nr. 2614/65, Rn. 97; EGMR , Sramek v. Austria, Urteil vom 22. Oktober 1984, Nr. 8790/79, Rn. 38 ff.; EGMR, Ettl and others v. Austria, Urteil vom 23. April 1987, Nr. 9273/81, Rn. 38; Oleksandr Volkov v. Ukraine, Urteil vom 9. Januar 2013, Nr. 21722/11, Rn. 110 ff.).

    Bestätigt wird dieser Befund dadurch, dass auch vom äußeren Erscheinungsbild her (zur Bedeutung des Anscheins für die Unparteilichkeit eines Gerichts im Sinne von Art. 6 EMRK vgl. EGMR, Oleksandr Volkov v. Ukraine, Urteil vom 9. Januar 2013, Nr. 21722/11, Rn. 104 - 106 m.w.N.) Zweifel an der Unparteilichkeit eines mit einem Richter auf Zeit besetzten Gerichts bestehen können.
