    Moreover, when considering the necessity of interference, the Court must be satisfied that that there existed sufficient and adequate guarantees against arbitrariness (ibid, and Matheron v. France, no. 57752/00, § 35, 29 March 2005), including the possibility of an effective control of the measure at issue (see mutatis mutandis, Lambert, cited above, § 34, Xavier Da Silveira, cited above, § 43 and Klass and Others v. Germany, 6 September 1978, §§ 50, 54 and 55, Series A no. 28).

    The Court must further assess whether an "effective control" was available to the applicant to challenge the measure to which he had been subjected (see mutatis mutandis, Lambert, cited above, § 34), and therefore whether subsequent to the implementation of that order the applicant had available any means for reviewing it, in his regard (see also, mutatis mutandis, Xavier Da Silveira, cited above, § 43 and Klass and Others cited above, §§ 50, 54 and 55, Series A no. 28).
