NIEMIETZ v. GERMANY
Auszug aus EGMR, 16.04.2002 - 37971/97
the applicants argue that in the course of its investigations the Commission infringed the principle of inviolability of the home within the meaning of Article 8 of the ECHR as interpreted in the case-law of the European Court of Human Rights (Niemietz v. Germany, judgment of 16 December 1992, Series A no. 251-B), whose review is more extensive than that performed in the context of Community law.Relying on Niemietz v. Germany (judgment of 16 December 1992, Series A no. 251-B), they considered that in the instant case, which concerned the business premises of public limited companies, the entitlement to interfere "might well be more far-reaching".

Auszug aus EGMR, 16.04.2002 - 37971/97

Klass u.a. ./. Deutschland
Auszug aus EGMR, 16.04.2002 - 37971/97
The exceptions provided for in paragraph 2 of Article 8 are to be interpreted narrowly (see Klass and Others v. Germany, judgment of 6 September 1978, Series A no. 28, p. 21, § 42), and the need for them in a given case must be convincingly established (see Funke, Crémieux and Miailhe (no. 1), cited above, p. 24, § 55, p. 62, § 38, and p. 89, § 36, respectively).

CHAPPELL c. ROYAUME-UNI
Auszug aus EGMR, 16.04.2002 - 37971/97
In Chappell v. the United Kingdom (judgment of 30 March 1989, Series A no. 152-A, pp. 12-13, § 26, and p. 26, § 63), the Court considered that a search conducted at a private individual's home which was also the registered office of a company run by him had amounted to interference with his right to respect for his home within the meaning of Article 8 of the Convention. - EGMR, 13.07.1983 - 8737/79
Zimmermann und Steiner ./. Schweiz
Auszug aus EGMR, 16.04.2002 - 37971/97
The Court reiterates that if it finds that there has been a violation of the Convention, it may award the applicant the costs and expenses incurred before the national courts for the prevention or redress of the violation (see Zimmermann and Steiner v. Switzerland, judgment of 13 July 1983, Series A no. 66, p. 14, § 36, and Hertel v. Switzerland, judgment of 25 August 1998, Reports of Judgments and Decisions 1998-VI, p. 2334, § 63). - EGMR, 27.09.1990 - 10843/84
COSSEY v. THE UNITED KINGDOM
Auszug aus EGMR, 16.04.2002 - 37971/97
The Court reiterates that the Convention is a living instrument which must be interpreted in the light of present-day conditions (see, mutatis mutandis, Cossey v. the United Kingdom, judgment of 27 September 1990, Series A no. 184, p. 14, § 35 in fine). - EGMR, 06.04.2000 - 35382/97
COMINGERSOLL S.A. v. PORTUGAL
Auszug aus EGMR, 16.04.2002 - 37971/97
As regards the rights secured to companies by the Convention, it should be pointed out that the Court has already recognised a company's right under Article 41 to compensation for non-pecuniary damage sustained as a result of a violation of Article 6 § 1 of the Convention (see Comingersoll v. Portugal [GC], no. 35382/97, §§ 33-35, ECHR 2000-IV).

Bosphorus Hava Yollari Turizm Ve Ticaret Anonim Sirketi ./. Irland
The Convention institutions had on numerous occasions examined the compatibility with the Convention of the discretion exercised by a State in applying Community law (see, inter alia, Van de Hurk v. the Netherlands, judgment of 19 April 1994, Series A no. 288; Procola v. Luxembourg, judgment of 28 September 1995, Series A no. 326; Cantoni and Hornsby, both cited above; Pafitis and Others v. Greece, judgment of 26 February 1998, Reports 1998-I; Matthews, cited above; S.A. Dangeville v. France, no. 36677/97, ECHR 2002-III; and Société Colas Est and Others v. France, no. 37971/97, ECHR 2002-III). - BVerfG, 27.04.2021 - 2 BvR 206/14

EGMR, Niemitz v. Germany, Urteil vom 16. Dezember 1992, Nr. 13710/88, § 29; Societé Colas Est and others v. France, Urteil vom 16. April 2002, Nr. 37971/97, § 41; Peck v. United Kingdom, Urteil vom 28.

Kruslin , a.a.O., S. 21, Nr. 29; Société Colas Est u. a. ./. Frankreich , Individualbeschwerde Nr. 37971/97, Nr. 43, ECHR 2002-III; und, sinngemäß, Lavents ./. As regards the latter point, the Court must first ensure that the relevant legislation and practice afford individuals adequate and effective safeguards against abuse (see Société Colas Est and Others v. Gleiches gilt für eine Beschlagnahme von E-Mails, die im Zuge von Durchsuchungen von beruflich genutzten Räumen bzw. Urteile des Europäischen Gerichtshofs für Menschenrechte vom 16. Dezember 1992, Niemietz/Deutschland, Serie A, Bd. 251-B, Nrn. 29-31, Société Colas Est u. a/Frankreich, Beschwerde Nr. 37971/97, EGMR 2002-III, Nrn. 40-41, sowie vom 2. - EGMR, 31.07.2008 - 40825/98

Chodorkowski: Moskauer Prozesse sind unfair
In that case the Court found no violation of Article 7 of the Convention, stressing that "it does not question the interpretation and application of national law by national courts unless there has been a flagrant non-observance or arbitrariness in the application of that law (see also Société Colas Est and Others v. France, no. 37971/97, § 43, ECHR 2002-III and, mutatis mutandis, Lavents v. Latvia, no. 58442/00, § 114, 28 November 2002)". - EGMR, 19.11.2020 - 24173/18

Moreover, according to its general approach, the Court does not question the interpretation and application of national law by national courts unless there has been a flagrant non-observance or arbitrariness in the application of that law (see, inter alia, Société Colas Est and Others v.
