The development of the Court's case-law concerning the constituent elements of the right of association can be summarised as follows: the Court has always considered that Article 11 of the Convention safeguards freedom to protect the occupational interests of trade-union members by the union's collective action, the conduct and development of which the Contracting States must both permit and make possible (see National Union of Belgian Police, cited above, § 39; Swedish Engine Drivers' Union, cited above, § 40; and Schmidt and Dahlström v. Article 14 comes into play whenever "the subjectmatter of the disadvantage ... constitutes one of the modalities of the exercise of a right guaranteed" (see National Union of Belgian Police v. Belgium, 27 October 1975, § 45, Series A no. 19), or the measure complained of is "linked to the exercise of a right guaranteed" (see Schmidt and Dahlström v. Specifically, to address the perceived dangers alluded to by the Romanian Government regarding the applicant union's potential right to strike - although this is certainly one of the most important union rights - the Grand Chamber judgment should have taken into account two aspects of the Court's case-law: (1) the right to strike is not an absolute right (see Schmidt and Dahlström v. Sweden, 6 February 1976, § 36, Series A no. 21, and Dilek and Others v. Turkey, nos. 74611/01, 26876/02 and 27628/02, § 68, 17 July 2007), and (2) limitations on the right to strike may under certain circumstances be permissible in a democratic society (see UNISON v. the United Kingdom (dec.) no. 53574/99, ECHR 2002-I; Federation of Offshore Workers" Trade Unions and Others v. That being so, and given that under the Court's case-law the right to strike was not the only means to protect occupational interest of trade union members by trade union action (see Schmidt and Dahlström v. Sweden, 6 February 1976, § 36, Series A no. 21), the Government argued that the interference in the present case had been proportionate to the legitimate aim pursued.[29] Indeed, this is an "important aspect" (as in Schmidt and Dahlström v. Sweden, judgment of 6 February 1976, Series A no. 21, p. 16, § 36), or even an "indispensable corollary" of the freedom of association of union trades (Enerji YAPI-YOL SEN, cited above, § 24, referring to the ILO language).
