    Since the Convention is intended to safeguard rights that are "practical and effective", it has to be ascertained whether the situation complained of amounted nevertheless to a de facto expropriation, as was argued by the applicants (see, among other authorities, the Sporrong and Lönnroth v. Sweden judgment of 23 September 1982, Series A no. 52, p. 24, para. 63).

    LOIZIDOU v. TURKEY

    On pourrait d'ailleurs distinguer la présente affaire de la cause Papamichalopoulos et autres c. Grèce - dans laquelle la Cour a constaté par son arrêt du 24 juin 1993 (série A no 260-B) qu'il y avait eu une ingérence continue dans les droits de propriété des requérants -, au motif que le gouvernement grec n'y a soulevé aucune exception ratione temporis.

    La Cour rappelle qu'elle a souscrit à la notion de violation continue de la Convention et à ses effets sur les limites temporelles à la compétence des organes de la Convention (voir, entre autres, les arrêts Papamichalopoulos et autres c. Grèce du 24 juin 1993, série A no 260-B, pp. 69-70, paras. 40 et 46, et Agrotexim et autres c. Grèce du 24 octobre 1995, série A no 330-A, p. 22, par. 58).

    Dans l'hypothèse d'une détention carcérale qui a commencé avant et s'est poursuivie après la date décisive, ou dans celle de terrains illégalement occupés avant et après ladite date (comme dans l'affaire Papamichalopoulos et autres c. Grèce, arrêt du 24 juin 1993, série A no 260-B), il ne fait aucun doute que la période postérieure relève de la juridiction de la Cour.
