    It can be seen from the case-law that the travaux préparatoires are not delimiting for the question whether a right may be considered to fall within the scope of an Article of the Convention if the existence of such a right was supported by the growing measure of common ground that had emerged in the given area (see, for example Sigurður A. Sigurjónsson v. Iceland, 30 June 1993, § 35, Series A no. 264).

    In this sense, Article 10 § 1 is different from the first paragraphs of Articles 8, 9 and 11 of the Convention, the latter being textually framed in such a way as to allow the Court more flexibility in recognising positive obligations and identifying novel rights than is possible under Article 10. It follows that the example given by the majority in this context in support of its findings, that is, the recognition of a negative right to freedom of association under Article 11 of the Convention, as found in the case of Sigurður A. Sigurjónsson v. Iceland (30 June 1993, § 35, Series A no. 264), is quite inapposite (see paragraph 125 of the judgment).

    The interests protected by Article 11 (art. 11) As the judgment points out (at paragraph 45), Article 11 (art. 11) has been interpreted to encompass also the negative aspect of freedom of association, namely the right not to join an association (see Sigurdur A. Sigurjónsson v. Iceland judgment of 30 June 1993, Series A no. 264, pp. 15-16, para. 35).

    Consequently, it becomes necessary in the present case to determine the question left open in the Sigurdur A. Sigurjónsson v. Iceland judgment (30 June 1993, Series A no. 264, p. 16, para. 35).

    In spite of a certain reluctance to "open the door" to the negative freedom of association (paragraph 45, sub-paragraph 2) the Court, following the Sigurdur A. Sigurjónsson v. Iceland judgment of 30 June 1993 (Series A no. 264, pp. 15-16, para. 35), has interpreted this Article (art. 11) in its logical sense that this negative right of association - the right not to join or to withdraw from a trade union - is only one aspect of the freedom of association with others.

    That a negative right of association is protected by Article 11, at least to some extent, has been confirmed in the Court's subsequent case-law, but as the majority rightly stressed, the Court has hitherto not taken any definite stand on whether the negative and positive aspects of the right to freedom of association should be afforded the same level of protection (see, in particular, Sigurjónsson v. Iceland (judgment of 30 June 1993, Series A no. 264, § 35)).
