Der Gerichtshof hat insbesondere festgestellt, dass in Fällen, in denen eine Person in gesundem Zustand in polizeilichen Gewahrsam genommen wird, bei der Entlassung jedoch Verletzungen an ihr festgestellt werden, der Staat eine plausible Erklärung dafür liefern muss, wie es zu diesen Verletzungen gekommen ist, und dass, falls dies unterbleibt, eindeutig eine Frage nach Artikel 3 der Konvention aufgeworfen wird (vgl. The Court would distinguish the present case from that of Tomasi v. France (see the judgment of 27 August 1992, Series A no. 241-A, pp. 40-42, paras. 108-115) where certain inferences could be made from the fact that Mr Tomasi had sustained unexplained injuries during forty-eight hours spent in police custody.As regards the question whether the force used by Police Constables Bolte and Wildschut against the first applicant for the purpose of her arrest was strictly proportionate, the Commission attaches particular weight to the injuries suffered by the first applicant in the course of her arrest (Eur. Court H. R., Tomasi v. France judgment of 27 August 1992, Series A no. 241-A, opinion of the Commission, pp. 51-52, paras. 92-100, 105).
I cannot therefore accept as a valid distinction the fact that in the case of Tomasi v. France (see the judgment of 27 August 1992, Series A no. 241-A), the applicant had been in custody for many hours.

The Court, having decided to accept the Commission's findings of fact (see paragraphs 39-40 above), considers that where an individual is taken into police custody in good health but is found to be injured at the time of release, it is incumbent on the State to provide a plausible explanation as to the causing of the injury, failing which a clear issue arises under Article 3 of the Convention (art. 3) (see the Tomasi v. France judgment of 27 August 1992, Series A no. 241-A, pp. 40-41, paras. 108-111 and the Ribitsch v. BALOGH v. HUNGARY
The Government, with reference to the Court's judgments in the cases of Selmouni v. France ([GC], no. 25803/94, ECHR 1999-V), Ribitsch v. Austria (judgment of 4 December 1995, Series A no. 336) and Tomasi v. France (judgment of 27 August 1992, Series A no. 241-A), accepted that where an individual was taken into custody but was found to be injured at the time of his release, it was incumbent on the State under Article 3 to provide a plausible explanation as to the cause of that injury.The requirements of an investigation and the undeniable difficulties inherent in the fight against crime cannot justify placing limits on the protection to be afforded in respect of the physical integrity of individuals (Tomasi v. France, judgment of 27 August 1992, Series A no. 241-A, p. 42, § 115).
The majority of my colleagues in the Chamber has rightly pointed out that it is well-established in the case-law of the Court that where an individual is taken into police custody in good health but is found to be injured at the time of release, it is incumbent on the State to provide a plausible explanation of how those injuries were caused, failing which a clear issue arises under Article 3 of the Convention (see the Tomasi v. France judgment of 27 August 1992, Series A no. 241-A, pp. 40-41, §§ 108-111, and the Ribitsch v. Austria judgment of 4 December 1995, Series A no. 336, pp. 25-26, § 34).

Where such grounds were "relevant" and "sufficient", the Court must also ascertain whether the competent national authorities displayed "special diligence" in the conduct of the proceedings (see, as the most recent authority, the Tomasi v. France judgment of 27 August 1992, Series A no. 241-A, p. 35, para. 84).The Court points out that the danger of absconding cannot be gauged solely on the basis of the severity of the possible sentence; it must be assessed with reference to a number of other relevant factors which may either confirm the existence of a danger of absconding or make it appear so slight that it cannot justify pre-trial detention (see, as the most recent authority, the Tomasi judgment cited above, Series A no. 241-A, p. 37, para. 98).
