KARNER c. AUTRICHE
Auszug aus EGMR, 20.10.2010 - 9926/03
In the light of the above considerations the Court finds no special circumstances relating to respect for human rights as defined in the Convention and its Protocols which require it to continue the examination of the application in respect of RFSRO (for contrast see, for example, Karner v. Austria, no. 40016/98, § 27, ECHR 2003-IX, and Tehrani and Others v. Turkey, nos. 32940/08, 41626/08 and 43616/08, § 56, 13 April 2010). - EGMR, 24.11.2005 - 49429/99
CAPITAL BANK AD v. BULGARIA
Auszug aus EGMR, 20.10.2010 - 9926/03
While it is true that the claim determined in the impugned proceedings was pecuniary in nature and as such transferable, and that it was in fact later transferred to a third private entity, the Court observes that there was no connection between the impugned proceedings and the legal collapse of RFSRO (for contrast see, for example, OAO Neftyanaya kompaniya YUKOS, cited above, § 443 and Capital Bank AD v. Bulgaria, no. 49429/99, § 80, ECHR 2005-XII (extracts)). - EGMR, 13.04.2010 - 32940/08
TEHRANI AND OTHERS v. TURKEY

G.I.E.M. S.R.L. AND OTHERS v. ITALY
Suisse, no 41723/14, § 43, 22 décembre 2020 ; a contrario, RF SPOL. S R.O. c. - EGMR, 26.09.2017 - 39070/11
SPALLDI D.O.O. v. CROATIA
Human rights cases before the Court generally also have a moral dimension, which it must take into account when considering whether to continue with the examination of an application after the applicant has ceased to exist (see RF SPOL. S R.O. v. Slovakia, (dec.), 9926/03, 20 October 2010). - EGMR, 18.06.2019 - 50520/15
DOO VIO-MARK-IN INSOLVENCY v. NORTH MACEDONIA
The Court is aware that, in view of the applicant company having been struck off the registry of companies, there may be an issue with regard to its standing before the Court (see RF spol. s.r.o. v. Slovakia (dec.), no. 9926/03, 20 October 2010, and compare Aviakompaniya A.T.I., ZAT v. Ukraine, no. 1006/07, § 23, 5 October 2017).
