Z ET AUTRES c. ROYAUME-UNI
Auszug aus EGMR, 30.09.2010 - 12451/04
Given that the complaint indicated the existence of a legislative gap, the Court decided to examine it from the standpoint of Article 13 of the Convention (see, mutatis mutandis, Z and Others v. the United Kingdom [GC], no. 29392/95, § 102-103, ECHR 2001-V; Volokhy, cited above, §§ 55-61; and Iliya Stefanov v. Bulgaria, no. 65755/01, §§ 57-60, 22 May 2008). - EGMR, 22.05.2008 - 65755/01

KUZMINAS v. RUSSIA
The Court reiterates that the expression "in accordance with the law" in Article 8 § 2 of the Convention essentially refers back to national law and states the obligation to conform to the substantive and procedural rules thereof (see, for instance, Vladimir Polishchuk and Svetlana Polishchuk v. Ukraine, no. 12451/04, § 44, 30 September 2010). - EGMR, 05.10.2017 - 33015/06
VOSKOBOYNIKOV v. UKRAINE
As regards the possibility of instituting civil proceedings against the police officers, the Court found a violation of Article 13 of the Convention in the case of Vladimir Polishchuk and Svetlana Polishchuk v. Ukraine (no. 12451/04, §§ 54 and 55, 30 September 2010), where a civil claim in respect of an unlawful search had not been considered by the domestic courts, mainly because the claimant had not been directly involved in the relevant criminal proceedings. - EGMR, 07.07.2016 - 4322/06
ZOSYMOV v. UKRAINE
If no remedies are available or if those available are judged to be ineffective, the six-month period in principle runs from the date of the act complained of (see, among other authorities, Vladimir Polishchuk and Svetlana Polishchuk v. Ukraine, no. 12451/04, § 38, 30 September 2010).
