The Court reiterates that where it finds a violation of the Convention it may award the applicants the costs and expenses they have incurred before the national courts for the prevention or redress of the violation (see, among other authorities, Zimmermann and Steiner v. UMLAUFOVÁ c. RÉPUBLIQUE TCHÈQUE
Se référant à l'arrêt de la Cour dans l'affaire Pincová et Pinc c. République tchèque (no 36548/97, CEDH 2002-VIII), il estima que ladite disposition, qui ne prévoyait que le remboursement du prix d'achat initial, ne permettait pas d'accorder aux personnes concernées une compensation adéquate.Elle a donc fait sien l'avis de la Cour qui a considéré que la législation - ou la pratique - devrait permettre de tenir compte des circonstances particulières de chaque espèce, afin que les personnes ayant acquis leurs biens de bonne foi ne soient pas amenées à supporter le poids de la responsabilité de l'Etat qui avait jadis confisqué ces biens (voir Pincová et Pinc c. République tchèque, no 36548/97, § 58, CEDH 2002-VIII ; Otava c. République tchèque, no 36561/05, § 59, 27 mai 2010).

De surcroît, il ressort clairement de sa jurisprudence que si la Cour a pu estimer que les lois de restitution mises en Å“uvre pour atténuer les conséquences d'atteintes massives aux droits de propriété, causées, par exemple, par les régimes communistes, poursuivaient un but légitime, elle a toutefois jugé nécessaire de faire en sorte que l'atténuation des anciennes atteintes ne crée pas de nouveaux torts disproportionnés (voir, par exemple, Pincová et Pinc c.
