The Court reiterates its constant case-law on the length of pre-trial detention, in particular concerning the presumption in favour of release, the calculation of the detention period and the obligation for the authorities to provide "relevant and sufficient grounds" for continued detention (see Wemhoff v. Germany, 27 June 1968, § 9, Series A no. 7; Negoescu v. Romania (dec.), no. 55450/00, 17 March 2005; and Bykov v. MARIANA MARINESCU c. ROUMANIE
Dans l'affaire Stoican c. Roumanie (no 3097/02, 6 octobre 2009), la Cour a accordé une somme de 2 000 EUR à la requérante (une ancienne juge inculpée de graves infractions) pour une violation de l'article 5 § 3, et dans l'affaire Viorel Burzo c. Roumanie (nos 75109/01 et 12639/02, 30 juin2009), elle a octroyé 10 000 EUR au requérant (également un ancien juge) en réparation de violations des articles 3, 5 § 3 et 8.
