ASHINGDANE v. THE UNITED KINGDOM
Auszug aus EGMR, 12.11.2013 - 26873/06
The Court reiterates that the right of access to the courts is not absolute, but may be subject to limitations; these are permitted by implication, particularly in respect of conditions for the admissibility of an appeal on points of law, since "by its very nature it calls for regulation by the State, which enjoys in this respect a certain margin of appreciation" (see Ashingdane v. the United Kingdom, 28 May 1985, § 57, Series A no. 93). - EGMR, 15.05.2012 - 33065/05
KRASTEV v. BULGARIA
Auszug aus EGMR, 12.11.2013 - 26873/06
Furthermore, a limitation will not be compatible with Article 6 § 1 if it does not pursue a legitimate aim and if there is not a reasonable relationship of proportionality between the means employed and the aim sought to be achieved (see Krastev v. Bulgaria, (dec.) no. 33065/05, § 24, 15 May 2012).

PETRASCU v. ROMANIA
The Court reiterates that the right of access to court is not absolute, but may be subject to limitations; these are permitted by implication, particularly in respect of conditions for the admissibility of an appeal on points of law, since "by its very nature it calls for regulation by the State, which enjoys in this respect a certain margin of appreciation" (see Trif v. Romania (dec.), no. 26873/06, § 36, 12 November 2013).
