Secondly, the Government pointed out that the Court had expressly ruled that litigation over tax could not be regarded as being related to civil rights and obligations (Ferrazzini v. Italy, [GC], no. 44759/98, 12 July 2001). - EGMR, 27.02.1980 - 6903/75
DEWEER c. BELGIQUE
Auszug aus EGMR, 03.12.2002 - 52938/99
The Court also reiterates that the prominent place held in a democratic society by the right to a fair trial favours a "substantive", rather than a "formal", conception of the "charge" referred to by Article 6 and impels the Court to look behind the appearances and examine the realities of the procedure in question (Deweer v. Belgium, judgment of 27 February 1980, Series A no. 35, p. 23, § 44; Adolf v. Austria, judgment of 26 March 1982, Series A no. 49, p. 15, § 30). - EGMR, 26.03.1982 - 8269/78

BENDENOUN c. FRANCE
Auszug aus EGMR, 03.12.2002 - 52938/99
It was true that a taxpayer acting in bad faith could on occasion be required by Article 1729 § 1 of the General Tax Code to pay a tax surcharge with the criminal connotation which that entailed (Bendenoun v. France, judgment of 24 February 1994, Series A no. 284, p. 20, § 47).

M. M. gegen Deutschland
- EGMR, 09.06.2005 - 62512/00

Italien [GK], Individualbeschwerde Nr. 44759/98, Nr. 29, ECHR 2001-VII; Mieg de Boofzheim ./. Frankreich, Individualbeschwerde Nr. 52938/99, ECHR 2002-X; Remy u. a. ./.Deutschland (Entscheidung) , Individualbeschwerde Nr. 70826/01, 16. September 2004). - EGMR, 20.03.2012 - 25363/09
RADO ET MAURY c. FRANCE
France (déc.), no 31050/06, 9 décembre 2008). - EGMR, 17.05.2016 - 76959/11
SOCIÉTÉ OXYGÈNE PLUS c. FRANCE
France (déc.), no 52938/99, CEDH 2002-X, et Poniatowski c. France (déc.), no 29494/08, 6 octobre 2009). - EGMR, 09.12.2008 - 31050/06
SCI PARC DE VALLAURIS c. FRANCE
France du 3 décembre 2002, no 52938/99, CEDH 2002-X).
