The case differed from those of Saunders and Funke (Funke v. France, 25 February 1993, Series A no. 256-A), decided by the Court, in that there had been no use made of a separate procedure to elicit a confession from the suspect with the aim to use it against him.The applicants relied in the first place on what they called the nemo tenetur principle, which the Court had recognised in Funke v. France (25 February 1993, Series A no. 256-A), Saunders v. the United Kingdom (17 December 1996, Reports 1996-VI) and Quinn v. Ireland (no. 36887/97, 21 December 2000), as a basic requirement of fairness enshrined in Article 6 § 1 of the Convention under its criminal head.

The Court next reiterates that although the right to remain silent under police questioning and the privilege against self-incrimination (nemo tenetur seipsum accusare, also nemo tenetur seipsum prodere) are not specifically mentioned in Article 6 of the Convention, there can be no doubt that they are generally recognised international standards which lie at the heart of the notion of a fair procedure under that Article (see, among other authorities, John Murray v. the United Kingdom, 8 February 1996, § 45, Reports 1996-I, and Coëme and Others v. Belgium, nos. 32492/96, 32547/96, 32548/96, 33209/96 and 33210/96, § 26, ECHR 2000-VII).
