ARMANI DA SILVA c. ROYAUME-UNI
Auszug aus EGMR, 01.10.2019 - 74820/14
Otherwise, the general legal prohibition of torture and inhuman and degrading treatment and punishment would, despite its fundamental importance, be ineffective in practice, and it would be possible in some cases for agents of the State to abuse the rights of those within their control with virtual impunity (see Labita v. Italy [GC], no. 26772/95, § 131, ECHR 2000-IV, and Armani Da Silva v. the United Kingdom [GC], no. 5878/08, § 233, 30 March 2016). - EGMR, 04.12.1995 - 18896/91
RIBITSCH c. AUTRICHE
Auszug aus EGMR, 01.10.2019 - 74820/14
Where an individual is taken into police custody in good health and is found to be injured on release, it is incumbent on the State to provide a plausible explanation of how those injuries were caused, failing which a clear issue arises under Article 3 (see Ribitsch v. Austria, 4 December 1995, § 34, Series A no. 336, and Selmouni v. France [GC], no. 25803/94, § 87, ECHR 1999-V). - EGMR - 45886/07
[FRE]
Auszug aus EGMR, 01.10.2019 - 74820/14
Any deficiency in the investigation which undermines its ability to establish the cause of injuries or the identity of the persons responsible will risk falling foul of this standard (see Mocanu and Others v. Romania [GC], nos. 10865/09, 45886/07 and 32431/08, § 322, ECHR 2014 (extracts), and Kopylov v. Russia, no. 3933/04, § 133, 29 July 2010). - EGMR, 05.11.2013 - 36716/07
MESUT DENIZ v. TURKEY
Auszug aus EGMR, 01.10.2019 - 74820/14
Furthermore, the investigation must be independent, impartial and subject to public scrutiny (see Mesut Deniz v. Turkey, no. 36716/07, § 52, 5 November 2013). - EGMR, 23.10.2014 - 33856/05
BOBROV v. RUSSIA
Auszug aus EGMR, 01.10.2019 - 74820/14
In relation to detainees, the Court has emphasised that persons in custody are in a vulnerable position and that the authorities are under a duty to protect their physical well-being (see, with further references, Bobrov v. Russia, no. 33856/05, § 33, 23 October 2014).
