DE JONG, BALJET ET VAN DEN BRINK c. PAYS-BAS
Auszug aus EGMR, 03.10.2006 - 34503/03
The Court considers that this complaint falls to be examined under Article 5 § 4 alone, being the lex specialis in the field of deprivation of liberty, with stricter requirements compared to Article 13 of the Convention (see De Jong, Baljet and Van Den Brink v. the Netherlands, judgment of 22 May 1984, Series A no. 77, p. 27, § 60 in fine).

SHTUKATUROV v. RUSSIA
The applicant further referred to the awards made by the Court in comparable cases (see, for example, Gajcsi v. Hungary, no. 34503/03, §§ 28-30, 3 October 2006, and H.F. v. Slovakia, no. 54797/00, §§ 50-52, 8 November 2005). - EGMR, 28.11.2017 - 59152/08
N. c. ROUMANIE
En effet, le tribunal n'a aucunement établi que le requérant était dangereux pour lui-même ou pour les autres, en raison notamment de sa pathologie psychiatrique (voir, mutatis mutandis, Gajcsi c. Hongrie, no 34503/03, § 21, 3 octobre 2006). - EGMR, 26.07.2011 - 46372/09
KARAMANOF c. GRÈCE
Il doit être établi que la privation de liberté de l'intéressé était indispensable au vu des circonstances (Herczegfalvy c. Autriche, arrêt du 24 septembre 1992, série A no 244 ; Litwa c. Pologne, no 26629/95, § 78, CEDH 2000-III et Gajcsi c. Hongrie, no 34503/03, 3 octobre 2006). - EGMR, 11.01.2011 - 19547/07
DARVAS v. HUNGARY
The Court would further reiterate that formally valid detention orders do not necessarily fulfil the requirements of Article 5 § 1 if not underpinned by sufficient reasons (see, mutatis mutandis, Gajcsi v. Hungary, no. 34503/03, §§ 18-21, 3 October 2006). - EGMR, 23.09.2014 - 62924/10
GAJCSI v. HUNGARY
On 3 October 2006 the Court found a violation of Article 5 § 1 concerning his psychiatric detention (see Gajcsi v. Hungary, no. 34503/03).
