H?KANSSON AND STURESSON v. SWEDEN
Auszug aus EGMR, 18.10.2005 - 49453/99
A waiver can be done explicitly or tacitly, in the latter case for example by refraining from submitting or maintaining a request for a hearing (see Håkansson and Sturesson v. Sweden, judgment of 21 February 1990, Series A no. 171-A, p. 20, § 66; and Schuler-Zgraggen v. Switzerland, judgment of 24 June 1993, Series A no. 263, pp. 19-20, § 58). - EGMR, 12.05.1992 - 13770/88
MEGYERI c. ALLEMAGNE
Auszug aus EGMR, 18.10.2005 - 49453/99
The Court also reiterates that the requirements under Article 6 are generally stricter than those under Article 5 § 4 (see Megyeri v. Germany, judgment of 12 May 1992, Series A no. 237-A, p. 11, § 22). - EGMR, 24.06.1993 - 14518/89
SCHULER-ZGRAGGEN c. SUISSE
- EGMR, 29.10.1991 - 11826/85
HELMERS c. SUÈDE
Auszug aus EGMR, 18.10.2005 - 49453/99
However, the absence of a hearing before a second or third instance may be justified by the special features of the proceedings in issue, provided a hearing has been held at first instance (see Helmers v. Sweden, judgment of 29 October 1991, Series A no. 212-A, p. 16, § 36).

ISELSTEN v. SWEDEN
The absence of a hearing before a second or third instance may be justified by the special features of the proceedings at issue (see, among many other authorities, Jan Åke Andersson, cited above, § 29; Helmers, cited above, § 36; Ivanovski v. the former Yugoslav Republic of Macedonia (dec.) no. 21261/02, 29 September 2005; and Kaipila v. Finland (dec.), no. 49453/99, 18 October 2005). - EGMR, 04.02.2010 - 17169/06
FELLER v. AUSTRIA
Relying on the case of Kaipila v. Finland (Decision, no. 49453/99, 18 October 2005), the Government argued that also in the present case the decision to be taken by the authority had to rely to a large extent on the expert opinion of medical doctors and therefore was better determined in writing.
