König ./. Deutschland
Auszug aus EGMR, 21.05.2015 - 69319/12
However, such a decision must be proportionate and have regard to the special circumstances of the case (see König v. Germany, 28 June 1978, § 110, Series A no. 27; Boddaert v. Belgium, 12 October 1992, § 39, Series A no. 235-D; and Herbst v. Germany, no. 20027/02, § 78, 11 January 2007). - EGMR, 27.03.2003 - 58698/00
PAULINO TOMAS contre le PORTUGAL
Auszug aus EGMR, 21.05.2015 - 69319/12
Reiterating lastly that while it cannot be ruled out that excessive delays in an action for compensation will render the remedy inadequate (see Paulino Tomás v. Portugal (dec.), no. 58698/00, ECHR 2003-VIII; Belinger v. Slovenia (dec.), no. 42320/98; and Cocchiarella, cited above, § 86), the Court considers that in the present case the duration of the proceedings, even though amounting to a violation of Article 6 § 1 of the Convention, was not of such significance as to call into question the effectiveness of the remedy as such (see Belperio and Ciarmoli, cited above, § 53). - EGMR, 10.07.1984 - 8990/80
GUINCHO c. PORTUGAL
Auszug aus EGMR, 21.05.2015 - 69319/12
It notes in this respect that the States are under the obligation to organise their legal systems so as to ensure compliance with the requirements of Article 6 § 1, including the reasonable-time requirement (see, among many authorities, Guincho v. Portugal, 10 July 1984, § 38, Series A no. 81, and Süßmann, cited above, § 55). - EGMR, 13.06.2002 - 42320/98
BELINGER v. SLOVENIA

ZIROVNICKÝ v. THE CZECH REPUBLIC
The Court, being master of the characterisation to be given in law to the facts of the case (see, among other authorities, Guerra and Others v. Italy, 19 February 1998, § 44, Reports of Judgments and Decisions 1998-I; and, in the context of length-of-proceedings cases, Beggs v. the United Kingdom, no. 25133/06, § 205, 6 November 2012, or Chuykina v. Ukraine, no. 28924/04, § 31, 13 January 2011) and, having regard to its previous case-law, (in particular, Hajrudinovic v. Slovenia, no. 69319/12, 21 May 2015, and Gagliano Giorgi v. Italy, no. 23563/07, ECHR 2012 (extracts)), finds it appropriate to examine this complaint under both Article 6 § 1 and Article 13 separately. - EGMR, 15.11.2016 - 60439/12
Italie, no 7932/04, § 53, 21 décembre 2010, Golha, précité, § 73, et Hajrudinovic c. Slovénie, no 69319/12, § 58, 21 mai 2015) ), bien qu'elle ait été plus stricte dans son appréciation dans l'affaire Xynos c. Grèce (no 30226/09, § 45, 9 octobre 2014).
