Les requérants sont les héritiers de M.J. qui était propriétaire de trois terrains, d'une superficie totale de 931 hectares, lesquels firent l'objet d'une expropriation en 1975 dans le cadre de la politique relative à la réforme agraire (voir, à cet égard, Almeida Garrett, Mascarenhas Falcão et autres c. Portugal, nos 29813/96 et 30229/96, § 54, CEDH 2000-I).Y a-t-il eu atteinte au droit des requérants au respect de leurs biens, tel que garanti par l'article 1 du Protocole no 1, en raison du délai pris par les autorités internes pour fixer et payer l'indemnité pour la privation temporaire des propriétés de M.J. lors de la réforme agraire lancée en 1975 au Portugal (voir Almeida Garrett, Mascarenhas Falcão et autres c. Portugal, nos 29813/96 et 30229/96, § 54, CEDH 2000-I, Ramos Ferreira et autres c. Portugal, nos 23321/11 et 2 autres, § 31, 16 juillet 2013, et Companhia Agrícola da Apariça, SA c. (Requêtes nos 29813/96 et 30229/96).Alexandre de Almeida Garrett, José Mascarenhas Falcão, Francisco Augusto Mascarenhas Falcão, Mmes Maria Teresa Mascarenhas de Oliveira Falcão de Azevedo, Maria José Mascarenhas Falcão Themudo de Castro et Leone Marie Irion Falcão («les requérants»), avaient saisi la Commission les 5 janvier et 14 février 1996, en vertu de l'ancien article 25. Les requêtes ont été enregistrées les 16 janvier et 16 février 1996 sous les numéros de dossier 29813/96 et 30229/96, respectivement.
Elle a estimé par ailleurs qu'il ne s'imposait pas d'examiner les griefs tirés des articles 6, 13 et 17 de la Convention (arrêt Almeida Garrett, Mascarenhas Falcão et autres c. Portugal, nos 29813/96 et 30229/96, CEDH 2000-I).
