ADEN AHMED v. MALTA
The Court notes, however, that it has held on numerous occasions that constitutional proceedings in Malta are rather cumbersome for Article 5 § 4 purposes, and that lodging a constitutional application does not ensure a speedy review of the lawfulness of an applicant's detention (see Sabeur Ben Ali v. Malta, no. 35892/97, § 40, 29 June 2000; Kadem, cited above, § 53; Stephens v. Malta (no. 2), no. 33740/06, § 90, 21 April 2009; and Louled Massoud, cited above, § 45). - EGMR, 26.07.2001 - 33977/96
ILIJKOV v. BULGARIA
Having regard to its case-law (see the Lukanov v. Bulgaria judgment of 10 March 1997, Reports 1997-II, § 56; the Assenov and Others v. Bulgaria judgment of 28 October 1998; Reports 1998-VIII, §§ 176-178; Nikolova v. Bulgaria [GC], no. 31195/96, § 79, ECHR 1999-II; Jecius v. Lithuania, loc. cit., § 109; Punzelt v. the Czech Republic, no. 31315/96, 25 April 2000, unreported; Grauslys v. Lithuania, loc. cit.; Musial v. Poland, 24557/94, ECHR 1999-II; Sabeur Ben Ali v. Malta, no. 35892/97; and Varbanov v. Bulgaria, no. 31365/98, § 67, ECHR 2000-X), and ruling on an equitable basis, the Court awards the global sum of BGN 6, 000 under the head of non-pecuniary damage in respect of the violations of the Convention found in the present case. - EGMR, 23.07.2013 - 4458/10
MIKALAUSKAS v. MALTA
Moreover, while it is clear that, unlike the above-mentioned remedies, such jurisdictions would be competent to look at the lawfulness of the applicant's detention in the light of Article 5 § 3, the Court notes that it has held on numerous occasions that constitutional proceedings in Malta are rather cumbersome for Article 5 § 4 purposes, and that lodging a constitutional application could not ensure a speedy review of the lawfulness of an applicant's detention (see Sabeur Ben Ali v. Malta, no. 35892/97, § 40, 29 June 2000; Kadem, cited above § 53; Stephens (No. 2), cited above, § 90; and Louled Massoud, cited above § 45). - EGMR, 23.07.2013 - 42337/12
SUSO MUSA v. MALTA
However, the Court has also held on numerous occasions that constitutional proceedings in Malta are rather cumbersome for Article 5 § 4 purposes, and that lodging a constitutional application does not ensure a speedy review of the lawfulness of an applicant's detention (see Sabeur Ben Ali v. Malta, no. 35892/97, § 40, 29 June 2000; Kadem, cited above § 53; Stephens v. Malta (no. 2), no. 33740/06, § 90, 21 April 2009; and Louled Massoud, cited above, § 45). - EGMR, 30.01.2003 - 38884/97
NIKOLOV v. BULGARIA
cit.; Musial v. Poland, 24557/94, ECHR 1999-II; Sabeur Ben Ali v. Malta, no. 35892/97; Varbanov v. Bulgaria, no. 31365/98, § 67, ECHR 2000-X; Ilijkov v. Bulgaria, cited above, and Filiz and Kalkan v. Turkey, no. 34481/97, 20 June 2002, unreported), and deciding on an equitable basis the Court awards 2, 000 euros ("EUR") in respect of non-pecuniary damage.

OPEN DOOR AND DUBLIN WELL WOMAN v. IRELAND
Auszug aus EGMR, 06.07.1999 - 35892/97
In any event, given the Constitutional Court's judgments in the Nicholas Ellul and Aquilina cases, the applicant would have been probably dispensed from the obligation to exhaust domestic remedies in respect of this complaint (cf. Eur. Court HR, Open Door and Dublin Well Woman v. Ireland judgment of 29 October 1992, Series A no. 246-A, p. 23, § 50 and application No. 25644/94, T.W. v. Malta, Dec. 17.1.97, unpublished).
