The Court also decided to grant the cases priority under Rule 41 and to inform the parties that it was considering the suitability of applying a pilot-judgment procedure (see Broniowski v. Poland [GC], 31443/96, §§ 189-194 and the operative part, ECHR 2004-V, and Hutten-Czapska v. Poland [GC] no. 35014/97, ECHR 2006-..., §§ 231-239 and the operative part).In order to facilitate effective implementation of its judgments along these lines, the Court may adopt a pilot-judgment procedure allowing it to clearly identify in a judgment the existence of structural problems underlying the violations and to indicate specific measures or actions to be taken by the respondent State to remedy them (see Broniowski v. Poland [GC], 31443/96, §§ 189-194 and the operative part, ECHR 2004-V, and Hutten-Czapska v. Poland [GC] no. 35014/97, ECHR 2006-... §§ 231-239 and the operative part).
This adjudicative approach is, however, pursued with due respect for the Convention organs" respective functions: it falls to the Committee of Ministers to evaluate the implementation of individual and general measures under Article 46 § 2 of the Convention (see, mutatis mutandis, Broniowski v. Poland (friendly settlement) [GC], no. 31443/96, § 42, ECHR 2005-IX, and Hutten-Czapska v. Poland (friendly settlement) [GC], no. 35014/97, § 42, 28 April 2008).

The Chamber dismissed all these pleas, observing, in particular, that it could have regard to the facts which had occurred prior to ratification inasmuch as they could be considered to have created a continuous situation extending beyond that date or might have been relevant for the understanding of facts occurring after that date (see, in particular, Hutten-Czapska v. Poland [GC], no. 35014/97, §§ 147-153, ECHR 2006-VIII).The Court considers that the present case is suitable for the adoption of a pilot-judgment procedure within the meaning of Rule 61 of the Rules of Court, given that one of the fundamental implications of this procedure is that the Court's assessment of the situation complained of in a "pilot" case necessarily extends beyond the sole interests of the individual applicants and requires it to examine that case also from the perspective of the general measures that need to be taken in the interest of other potentially affected persons (see Broniowski v. Poland (friendly settlement) [GC], no. 31443/96, § 36, ECHR 2005-IX, and Hutten-Czapska v. Poland (friendly settlement) [GC], no. 35014/97, § 33, 28 April 2008).

A différentes dates, des biens immobiliers appartenant aux requérants, ou à leurs auteurs, furent intégrés au régime de l"« administration publique de l'habitat'institué en 1946 puis au « régime des baux spéciaux ", qui s'y substitua en 1974, et enfin au système des « loyers réglementés ", qui remplaça en 1994 le régime des baux spéciaux et demeura en application jusqu'au 10 juillet 2001 (voir à ce sujet Hutten-Czapska c. Pologne [GC], no 35014/97, concernant un «jeu combiné» de « dispositions défectueuses sur la fixation des loyers » et de « diverses restrictions aux droits des propriétaires en matière de cessation des baux », nous estimons que l'impossibilité pour le propriétaire de résilier le bail en présence de l'une des conditions limitativement prévues par la loi, alors que cette condition se présente après que le locataire a habité l'immeuble depuis au moins vingt ans, et cela automatiquement, sans que les différents intérêts soient mis en balance, rompt le «juste équilibre» évoqué ci-dessus.

Considering whether it is justified to apply Article 37 of the Convention in the context of the pilot-judgment procedure, the Court consistently held that it is a fundamental feature of that procedure that the Court's assessment of the situation complained of in a "pilot" case necessarily extends beyond the sole interests of the individual applicant and requires it to examine the case also from the perspective of the general measures that need to be taken in the interest of other already or potentially affected persons (see, among many other examples, Hutten-Czapska v.
