  Damit handelt es sich um Umstände, die unter den weiten Begriff des "Privatlebens" im Sinne von Art. 8 EMRK fallen (EGMR, Urt. v. 21.07.2022 - 5797/17, Darboe und Camara ./. Italien, BeckRS 2022, 17412, Rn. 123 f.).

  Entsprechend hat der EGMR im Urteil Darboe und Camara ./. Italien eine Verletzung von Art. 8 EMRK unter verfahrensrechtlichen Aspekten festgestellt und dabei ausdrücklich offengelassen, ob der dortige Beschwerdeführer wirklich minderjährig war (vgl. EGMR, Urt. v. 21.07.2022 - 5797/17, Darboe und Camara ./. Italien, BeckRS 2022, 17412, Rn. 131: "[...] the Court emphasises that it is not its task to speculate on whether or not the applicant was a minor at the time of his arrival in Italy [...]").

  Anders als im Fall Darboe und Camara ./. Italien (vgl. EGMR, Urt. v. 21.07.2022 - 5797/17, Darboe und Camara ./. Italien, BeckRS 2022, 17412, Rn. 148) ist im Fall des Antragstellers eine förmliche und mit Gründen versehene Behördenentscheidung über die Einschätzung als volljährig ergangen, die der Antragsteller mit einem Rechtsbehelf - dem Widerspruch - anfechten konnte.

  Der EGMR nennt im Urteil Darboe und Camara ./. Italien anwaltliche Vertretung als verfahrensrechtlichen "safeguard" (vgl. EGMR, Urt. v. 21.07.2022 - 5797/17, Darboe und Camara ./. Italien, BeckRS 2022, 17412, Rn. 155).

  b) Hinzu kommt, dass nach der Auslegung des Art. 8 EMRK durch den Europäischen Gerichtshof für Menschenrechte in seinem Urteil vom 21. Juli 2022 (Az. 5797/17) einem unbegleiteten minderjährigen Ausländer "sofort" ("promptly") ein Vormund oder gesetzlicher Vertreter zu bestellen ist (…vgl. EGMR-Urteil, Rn. 143) und die Einschätzung einer Person durch die nationalen Behörden im Fall von Zweifeln über die Minderjährigkeit von ausreichenden Garantien begleitet sein muss (…vgl. EGMR-Urteil, Rn. 155).

  Hinzu kommt auch hier, dass nach der Auslegung des Art. 8 EMRK durch den Europäischen Gerichtshof für Menschenrechte in seinem Urteil vom 21. Juli 2022 (Az. 5797/17) einem unbegleiteten minderjährigen Ausländer "sofort" ("promptly") ein Vormund oder gesetzlicher Vertreter zu bestellen ist (…vgl. EGMR-Urteil, Rn. 143).

  Für das Altersfeststellungsverfahren nach § 42f SGB VIII (juris: SGB 8) ist wegen Art. 8 EMRK (juris: MRK) ein Vormund oder gesetzlicher Vertreter unverzüglich zu bestellen, sobald die betroffene ausländische Person im Migrationskontext behauptet, minderjährig zu sein, und diesbezüglich Zweifel bestehen (vgl. EGMR, Urteil vom 21. Juli 2022 - Az. 5797/17).(Rn.18).

  Die sich für eine ausländische Person, die behauptet minderjährig zu sein, ergebenden Verfahrensgarantien aus Art. 8 EMRK stehen dem nicht entgegen (zu den Vorgaben des Art. 8 EMRK siehe EGMR, Urteil vom 21.7.2022 - 5797/17).

  (2) Hinzu kommt, dass nach der Auslegung des Art. 8 EMRK durch den Europäischen Gerichtshof für Menschenrechte in seinem Urteil vom 21.
