It follows that the Court has temporal jurisdiction to examine the applicant's complaints, limited, however, to the procedural steps which were or ought to have been taken after the critical date (see Janowiec and Others v. The Court therefore lacks sufficient grounds to accept the Government's non-exhaustion claim, especially taking into account the fact that the proceedings in question concerned the applicant's request to be recognised as a victim, a procedural step which the investigating authority was required to take - both under domestic law and under the procedural obligation of Article 3 - of its own motion without leaving it to the applicant's own initiative (see, mutatis mutandis, Nachova and Others v. Bulgaria [GC], nos. 43577/98 and 43579/98, § 111, ECHR 2005-VII).
