Therefore, in the present case the Court is not called upon to decide whether the applicant's detention was lawful in terms of Article 5 § 1 (c), since the award of damages in any event constituted an acknowledgement of the alleged violation and adequate redress (see, by contrast, Dalban v. Romania [GC], no. 28114/95, § 44, ECHR 1999-VI).
