Auszug aus EGMR, 04.12.1989 - 14688/89
Although the notion of a civil right under this provision is autonomous of any domestic law definitions, the Commission considers that for the purposes of the domestic law in question and the Convention, the right not to be denied elementary education falls, in the circumstances of the present case, squarely within the domain of public law, having no private law analogy and no repercussions on private rights or obligations (cf. Eur. Court HR, Deumeland judgment of 29 May 1986, Series A no. 100 pp. 24-25 paras. 71-74). - EGMR, 23.10.1985 - 8848/80

EMINE ARAÇ v. TURKEY
The Government further pointed out that in its decision in André Simpson v. the United Kingdom (no. 14688/89, Commission decision of 4 December 1989, Decisions and Reports (DR) 64, p. 196), the Commission had held that Article 6 was inapplicable to proceedings concerning the laws on education. - EGMR, 11.01.2011 - 40385/06

Article 2 of Protocol No. 1 does not necessarily entail a right of access to a particular educational institution (Simpson v the United Kingdom, Application No. 14688/89, 24 February 1998). - EKMR, 20.05.1998 - 29043/95

McINTYRE v. THE UNITED KINGDOM
The Commission has more recently recognised "that there must be a wide measure of discretion left to the appropriate authorities as to how to make the best use possible of the resources available to them in the interests of disabled children generally" (see No. 14688/89, Dec. 4.12.89, D.R. 64, p. 194 and No. 28915/95, Dec. 17.1.97, unpublished). - EKMR, 17.01.1997 - 28915/95
