    MARKOVIC ET AUTRES c. ITALIE

    Auszug aus EGMR, 16.01.2024 - 24269/18
As for the applicant's argument that he had been deprived of access to a court, with no alternative remedy, the Supreme Court noted, with reference to Markovic and Others v. Italy ([GC], no. 1398/03, ECHR 2006-XIV), that that right could not be breached where a court lacked jurisdiction.

    TSANOVA-GECHEVA c. BULGARIE

    Auszug aus EGMR, 16.01.2024 - 24269/18
It has held that such a right to a lawful and fair promotion procedure exists under domestic law, and Article 6 is applicable as a result, in cases where national law expressly regulates the procedure and the procedural rights of the individual applicants for the respective positions, and the domestic courts had recognised their existence and had examined the relevant complaints of the applicants (see Tsanova-Gecheva v. Bulgaria (no. 43800/12, § 84, 15 September 2015, Frezadou, cited above, § 28), or the national Constitution and its interpretation by the Constitutional Court provided for the right of equal access to public service (see Gloveli, cited above, § 37).
  • EGMR, 20.06.2023 - 24492/21

    ALKAN v. TURKEY

    Auszug aus EGMR, 16.01.2024 - 24269/18
Similarly, the domestic courts dismissed the applicant's recourse considering that they did not have jurisdiction to review the SCJ's decisions under Article 146 or under any other Article of the Constitution, such as Article 28 - which was raised by the applicant (see paragraphs 10 and 13 above) - and declined to examine the applicant's arguments concerning the alleged unlawfulness of the SCJ's decision on the merits (see paragraphs 12 and 14 above) (compare Oktay Alkan v. Türkiye, no. 24492/21, § 41, 20 June 2023, where candidates in training who had applied for the position of judge or prosecutor had had access to the administrative courts in respect of the recruitment procedures; and Gloveli, cited above, § 38; Tsanova-Gecheva, cited above, § 84; and Dzhidzheva-Trendafilova, cited above, § 48, 9 October 2012, where the courts in each case had examined on the merits the applicants' challenges to the outcome of judicial competitions concerning the appointment or promotion of judges).

Betriebskrankenkasse der Heseper Torfwerke / Van Dijk

    Auszug aus EGMR, 16.01.2024 - 24269/18

  • EGMR, 07.05.2026 - 36862/23

    KONSTANTINOU v. CYPRUS

The relevant domestic case-law concerning the review of the former SCJ's decisions on judicial promotions, prior to the establishment of the new procedure, was recently summarised in Stylianidis v. Cyprus ((dec.), no. 24269/18, §§ 25-26, 16 January 2024) and previously in Kamenos (cited above, §§ 34-40).

The present case is therefore differentiated from that of Stylianidis v. Cyprus (dec.) (no. 24269/18, 16 January 2024), the facts of which took place prior to the establishment of the new procedure.

  • EGMR, 21.05.2026 - 62765/14

    SOBCZY?ƒSKA c. POLOGNE et 3 autres affaires

It should be noted in this connection that the Court has accepted, in its case-law, that the right to a lawful and fair promotion procedure could be considered as constituting a recognised right in domestic law, at least arguably, where the national Constitution in question and its interpretation by the Constitutional Court provided the right of equal access to public service (see Stylianidis v. Cyprus (dec), no. 24269/18, § 41, 8 February 2024 and the case-law cited therein).
  • EGMR, 26.03.2024 - 54699/14

KARTAL c. TURQUIE et 48 autres affaires

In view of the foregoing, the Court considers that the applicant's position as vice-president of the Inspection Board of the HSYK cannot be seen as a mere "advantage which it is not possible to have recognised in the courts" (see, in contrario, Davchev v. Bulgaria (dec), no. 39247/14, § 39, 19 September 2023, and Stylianidis v. Cyprus (dec), no. 24269/18, § 45, 8 February 2024).

    53193/21 and 5 others, § 98, 22 June 2023; and Stylianidis v. Cyprus (dec.), no. 24269/18, 16 January 2024)?.
