WITHEY contre le ROYAUME-UNI
Auszug aus EGMR, 02.11.2006 - 49163/99
Concerning the end of this period, the Court notes that one of the purposes of the right to a trial within a reasonable time is to protect individuals from remaining too long in a state of uncertainty about their fate (see Withey v. the United Kingdom (dec.), no. 59493/00, ECHR 2003-X; citing Stögmüller v. Austria, judgment of 10 November 1969, Series A no. 9, p. 40, § 5). - EGMR, 24.11.1993 - 13972/88
IMBRIOSCIA c. SUISSE
Auszug aus EGMR, 02.11.2006 - 49163/99
The Court, reiterating that the existence of a "charge" within the meaning of Article 6 § 1 is to be determined autonomously (see, among many other authorities, Imbrioscia v. Switzerland, judgment of 24 November 1993, Series A no. 275, p. 13, § 36), considers that the period to be taken into consideration began on 12 September 1994, when the applicant was first questioned in the course of the preliminary inquiry against her (see paragraph 11 above). - EGMR, 10.11.1969 - 1602/62
