  • EGMR, 28.06.1978 - 6232/73

    König ./. Deutschland

    Auszug aus EGMR, 23.03.2021 - 19090/20
This period covers the whole of the proceedings in question, including appeal proceedings (see König v. Germany, 28 June 1978, § 98, Series A no. 27).
  • OLG Karlsruhe, 30.03.2020 - HEs 1 Ws 84/20

Fortdauer der Untersuchungshaft wegen coronabedingter Aussetzung einer begonnenen

    Auszug aus EGMR, 23.03.2021 - 19090/20
In particular in a German case concerning similar complaints (see HEs 1 Ws 84/20 (OLG Karlsruhe, 30/03/2020)), the Karlsruhe Higher Regional Court held that in view of the high risk of infection and the lack of knowledge about the extent of the illness and of the risk of contagion for the persons involved in criminal proceedings the continued detention of the accused was proportionate to the aim pursued and not unlawful, irrespective of the fact that there was no certainty as to when proceedings could continue.
  • EGMR, 25.03.1999 - 25444/94

    PÉLISSIER AND SASSI v. FRANCE

    Auszug aus EGMR, 23.03.2021 - 19090/20
The reasonableness of the length of proceedings is to be assessed in the light of the particular circumstances of the case, regard being had to the criteria laid down in the Court's case-law, in particular the complexity of the case, the applicant's conduct and the conduct of the competent authorities (see, among many other authorities, Pélissier and Sassi v. France [GC], no. 25444/94, § 67, ECHR 1999-II).
  • EGMR, 27.06.1968 - 2122/64

    Wemhoff ./. Deutschland

    Auszug aus EGMR, 23.03.2021 - 19090/20
That right is based on the need to ensure that accused persons do not have to remain too long in a state of uncertainty as to the outcome of the criminal accusations against them (see Wemhoff v. Germany, 27 June 1968, § 18, Series A no. 7, and Kart v. Turkey [GC], no. 8917/05, § 68, ECHR 2009 (extracts)).
  • EGMR, 22.05.2012 - 5826/03

    IDALOV c. RUSSIE

    Auszug aus EGMR, 23.03.2021 - 19090/20
Continued detention can be justified in a given case only if there are actual indications of a genuine requirement of public interest which, notwithstanding the presumption of innocence, outweighs the rule of respect for individual liberty laid down in Article 5 of the Convention (see, among other authorities, Kudla v. Poland [GC], no. 30210/96, §§ 110 et seq, ECHR 2000-XI, and Idalov v. Russia [GC], no. 5826/03, § 139, 22 May 2012).
  • EGMR, 31.07.2000 - 34578/97

    JECIUS v. LITHUANIA

    Auszug aus EGMR, 23.03.2021 - 19090/20
In this connection the Court notes that a period of detention is, in principle, "lawful" if it is based on a court order (see Jecius v. Lithuania, no. 34578/97, § 68, ECHR 2000-IX, and Nevmerjitski v. Ukraine, no. 54825/00, § 116, ECHR 2005-II (extracts)).
  • EGMR, 26.06.1991 - 12369/86

    LETELLIER c. FRANCE

    Auszug aus EGMR, 23.03.2021 - 19090/20
It considered that granting the accused bail at that stage would have the effect of disturbing public order in the sense of the Court's decision in the case of Letellier v. France (26 June 1991, Series A no. 207) and other more recent case-law.
