With reference to Maktouf and Damjanovic v. Bosnia and Herzegovina ([GC], nos. 2312/08 and 34179/08, § 75, ECHR 2013 (extracts)), the Government contended that it would be incompatible with the principle of subsidiarity if the Court were to engage in a detailed assessment of the degree of the reduction of sentence as to do so would interfere with the State's penal policy, which the Contracting States were in principle free to decide.
