Although Article 3 cannot be construed as laying down a general obligation to release detainees on health grounds, it nonetheless imposes an obligation on the State to protect the physical and mental well-being of persons deprived of their liberty, for example by providing them with the requisite medical assistance (see Hurtado v. Switzerland, judgment of 28 January 1994, § 79 opinion of the Commission, Series A no. 280-A; Mouisel v. France, no. 67263/01, § 40, ECHR 2002-IX; Aerts v. Belgium, judgment of 30 July 1998, § 66, Reports of Judgments and Decisions 1998-V; Keenan v. the United Kingdom, no. 27229/95, § 111, ECHR 2001-III).It is fundamental to the machinery of protection established by the Convention that the national systems themselves provide redress for breaches of its provisions, with the Court exercising a supervisory role subject to the principle of subsidiarity (Z. and Others v. the United Kingdom, no. 29392/95, § 103, ECHR 2001-V).

Pour qu'il y ait obligation positive, il doit être établi que les autorités savaient ou auraient dû savoir sur le moment qu'un individu donné était menacé de manière réelle et immédiate dans sa vie du fait des actes criminels d'un tiers et qu'elles n'ont pas pris, dans le cadre de leurs pouvoirs, les mesures qui, d'un point de vue raisonnable, auraient sans doute pallié ce risque (Keenan c. Royaume-Uni, no 27229/95, §§ 89-90, CEDH 2001-III, Opuz, précité, § 129, et Gongadzé c. Ukraine, no 34056/02, § 165, CEDH 2005-XI).La Cour rappelle que cette disposition exige que l'ordre interne offre un recours effectif habilitant l'instance nationale à connaître du contenu d'un grief défendable fondé sur la Convention (Z et autres c. Royaume-Uni [GC], no 29392/95, § 108, CEDH 2001-V).

Pour ce qui est plus précisément des conditions de détention de personnes malades, le Gouvernement se réfère principalement aux arrêts Keenan c. Royaume-Uni, (no 27229/95, CEDH 2001-III) et Matencio c. France, (no 58749/00, 15 janvier 2004) dans lesquels la Cour a estimé respectivement que « l'état de santé, l'âge et un lourd handicap physique constituent désormais des situations pour lesquelles la question de la capacité à la détention est aujourd'hui posée au regard de l'article 3 » et que « certains traitements enfreignent l'article 3 du fait qu'ils sont infligés à une personne souffrant de troubles mentaux ».Ainsi, en procédant à l'examen de l'état de santé du prisonnier et aux effets de la détention sur son évolution, la Cour a considéré que certains traitements enfreignent l'article 3 du fait qu'ils sont infligés à une personne souffrant de troubles mentaux (arrêt Keenan c. Royaume-Uni, no 27229/95, §§ 111-115, CEDH 2001-III).
En particulier, pour apprécier si le traitement ou la sanction concernés étaient incompatibles avec les exigences de l'article 3, il faut, dans le cas des malades mentaux, tenir compte de leur vulnérabilité et de leur incapacité, dans certains cas, à se plaindre de manière cohérente ou à se plaindre tout court des effets d'un traitement donné sur leur personne (voir, par exemple, l'arrêt Aerts c. Belgique du 30 juillet 1998, Recueil 1998-V, p. 1966, § 66, et Keenan c. Royaume-Uni, no 27229/95, § 111, CEDH 2001-III).

As set out in Z. and Others v. the United Kingdom [GC], (no. 29392/95, ECHR 2001-V), negligence arises in specific categories of situations.Thus a failure, over four and a half years, to protect children from serious neglect and abuse of which the local authority were aware disclosed a breach of Article 3 of the Convention in the case of Z. and Others v. the United Kingdom ([GC] no. 29392/95, ECHR 2001-V, §§ 74-75).
Furthermore, in the case of a breach of Articles 2 and 3 of the Convention, which rank as the most fundamental provisions of the Convention, compensation for the non-pecuniary damage flowing from the breach should in principle be available as part of the range of redress (see Z. and Others v. the United Kingdom [GC], no. 29392/95, ECHR 2001-V, § 109; Keenan v. the United Kingdom, no. 27229/95, (Sect. 3), ECHR 2001-III, § 129).

Bulgaria, no. 39272/98, §§ 16-21, 30 and 153, ECHR 2003-XII), beating all over the body with wooden planks, leading to multiple rib fractures (see Secic v. Croatia, no. 40116/02, § 8, 11 and 51, ECHR 2007-VI), and anal fissure caused by several attackers in highly intimidating circumstances (see Nikolay Dimitrov v.
