In both contexts regard must be had to the fair balance that has to be struck between the competing interests of the individual and the community as a whole, and in both contexts the State is recognised as enjoying a certain margin of appreciation (see Hokkanen v. While it is not excluded that respect for family and private life extends to certain situations after death, for example, the ability to attend a close relative's funeral (Ploski v. Telle qu'interprétée par la Cour, la notion de traitements inhumains au sens de la Convention doit correspondre à un seuil minimum de gravité pour tomber sous le coup de l'article 3. L'appréciation de ce minimum est relative par essence et dépend de l'ensemble des données de la cause (cf. arrêt Irlande c. Royaume-Uni du 18 janvier 1978, série A n° 25, p. 65, § 162 ; arrêt Tyrer c. Royaume-Uni du 25 avril 1978, série A n° 26, p.).
