POPOV v. RUSSIA
Auszug aus EGMR, 03.10.2013 - 56539/08
In particular, "as a general rule, it is for the national courts to assess the evidence before them as well as the relevance of the evidence which defendants seek to adduce... Article 6 § 3 (d) leaves it to them, again as a general rule, to assess whether it is appropriate to call witnesses"; that provision "does not require the attendance and examination of every witness on the accused's behalf: its essential aim, as is indicated by the words "under the same conditions", is a full "equality of arms" in the matter" (see Perna v. Italy [GC], no. 48898/99, § 29, ECHR 2003-V, and Popov v. Russia, no. 26853/04, § 176, 13 July 2006).
