    KIRDÖK ET AUTRES c. TURQUIE

    Auszug aus EGMR, 16.11.2021 - 698/19
However, it does not appear to follow from the domestic law that material in respect of which the applicability of legal professional privilege is disputed would not be made available to the investigative authorities before the domestic courts have had a chance to conduct a specific and detailed analysis of the matter, and - if necessary - order the return or destruction of seized data carriers and/or their copied content (compare Kirdök and Others v. Turkey, no. 14704/12, § 51, 3 December 2019; Vinci Construction and GTM Génie Civil et Services v. France, nos. 63629/10 and 60567/10, § 79, 2 April 2015).

Domestic law must further be compatible with the rule of law and accessible to the person concerned, and the person affected must be able to foresee the consequences of the domestic law for him or her (see, inter alia, Big Brother Watch and Others v. the United Kingdom [GC], nos. 58170/13 and 2 others, § 332, 25 May 2021; see also Société Colas Est and Others v. France, no. 37971/97, § 43, ECHR 2002-III; Wolland v. Norway, no. 39731/12, § 62, 17 May 2018; and Särgava v. Estonia, no. 698/19, § 86, 16 November 2021).

    FASANO v. ITALY

    (b) In light of the fact that the monitoring activities covered all communications on the applicant's telephone lines and conversations in the applicant's law firm from October 2008 to April 2009, did the law afford effective safeguards against abuse or arbitrariness, particularly having regard to the confidentiality of relations with his clients (see, mutatis mutandis, Kopp, cited above, §§ 72-74; Ekimdzhiev and Others v. Bulgaria, no. 70078/12, § 333, 11 January 2022; and, in the context of a seizure of a lawyer's laptop and mobile telephone, Särgava v. Estonia, no. 698/19, § 98, 16 November 2021)?.

    Z.G. v. HUNGARY

Has there been a violation of the applicant's right to respect for his private life and/or correspondence and/or home, contrary to Article 8 of the Convention, on account of the search of his premises and seizure of documents (Robathin v. Finally, the domestic law must contain a specific procedure or safeguards to address the examination of electronic data carriers containing protected materials (see, mutatis mutandis, in the context of searches of legally privileged (attorney-client) materials, Särgava v.
