ASSANIDZE v. GEORGIA
Auszug aus EGMR, 20.10.2016 - 52819/08
Although it is in the first place for the national authorities, notably the courts, to interpret and apply domestic law, under Article 5 § 1 failure to comply with domestic law entails a breach of the Convention and the Court can and should review whether this law has been complied with (see, among many other references, Benham v. the United Kingdom, 10 June 1996, § 41, Reports 1996-III, and Assanidze v. Georgia [GC], no. 71503/01, § 171, ECHR 2004-II). - EGMR, 19.02.2009 - 16505/02
DORONIN v. UKRAINE
Auszug aus EGMR, 20.10.2016 - 52819/08
Accordingly, looking beyond the appearances and the language used, and concentrating on the realities of the situation, the Court considers that the applicant's administrative detention was in reality part of his detention on remand under Article 5 § 1 (c) as a criminal suspect in the murder case without, however, safeguarding his procedural rights as a suspect (see Kafkaris v. Cyprus [GC], no. 21906/04, § 116, ECHR 2008, and Doronin v. Ukraine, no. 16505/02, §§ 55-56, 19 February 2009).

URAZBAYEV c. RUSSIE
Russie, no 59261/00, §§ 85-86, CEDH 2006-III, Doronine c. Ukraine, no 16505/02, § 56, 19 février 2009, Oleksiy Mykhaylovych Zakharkin c. Ukraine, no 1727/04, § 88, 24 juin 2010, Nechiporuk et Yonkalo c. Ukraine, no 42310/04, § 178, 21 avril 2011, et, dernièrement, Semenenko c. Ukraine [comité], no 52819/08, §§ 29-36, 20 octobre 2016). - EGMR, 15.10.2019 - 52673/07
GRIGORYEV c. RUSSIE
Ukraine, no 16505/02, § 56, 19 février 2009, Oleksiy Mykhaylovych Zakharkin c. Ukraine, no 1727/04, § 88, 24 juin 2010, Nechiporuk et Yonkalo c. Ukraine, no 42310/04, § 178, 21 avril 2011, et, dernièrement, Semenenko c. Ukraine (comité), no 52819/08, §§ 29-36, 20 octobre 2016).
