Sergeï Zolotoukhine ./. Russland
Auszug aus EGMR, 31.08.2021 - 45512/11
The notion of the "same offence" - the idem element of the ne bis in idem principle in Article 4 of Protocol No. 7 - was clarified in Sergey Zolotukhin v. Russia ([GC], no. 14939/03, §§ 78-84, ECHR 2009). - EGMR, 10.02.1983 - 7299/75
ALBERT ET LE COMPTE c. BELGIQUE
Auszug aus EGMR, 31.08.2021 - 45512/11
When assessing whether the accused had adequate time for the preparation of his defence, particular regard has to be had to the nature of the proceedings, as well as the complexity of the case and the stage of the proceedings (see Gregacevic, cited above, § 51, and Albert and Le Compte v. Belgium, 10 February 1983, § 41, Series A no. 58). - EGMR, 21.06.2011 - 29652/04
ORLOV v. RUSSIA
Auszug aus EGMR, 31.08.2021 - 45512/11
The competent national authorities are required under Article 6 § 3 (c) to intervene only if a failure by legal-aid counsel to provide effective legal assistance is manifest or sufficiently brought to their attention in another way (see Czekalla v. Portugal, no. 38830/97, § 60, ECHR 2002-VIII, and Orlov v. Russia, no. 29652/04, § 108, 21 June 2011).

VASILE SORIN MARIN v. ROMANIA
The Court concludes therefore the criminal proceedings cannot be regarded as a complementary response to the applicant's unlawful behaviour, aimed at addressing an ongoing situation of violence in a comprehensive manner, once it was found that the behaviour had reached a certain level of severity (contrast Galovic v. Croatia, no. 45512/11, §§ 117-18, 31 August 2021). - EGMR, 16.06.2022 - 1735/13
GOULANDRIS AND VARDINOGIANNI v. GREECE
The facts in the subsequent criminal proceedings were not even partly identical to the facts in the preservation-fine proceedings (compare and contrast Galovic v. Croatia, no. 45512/11, § 112, 31 August 2021). - EGMR, 02.12.2021 - 12699/18
TORADZE v. GEORGIA
Even if treating the various alleged incidents of violence as amounting to a continuous act of domestic violence (see Galovic v. Croatia, no. 45512/11, § 116, 31 August 2021, with further references), the Court, nevertheless, finds that the application was introduced outside the six months' time-limit.
