It must, however, be established that the injuries in question actually occurred in the way alleged by the applicant, and it is not normally for the Convention organs to substitute their own assessment of the facts for that of the domestic courts (Eur. Court H.R., Klaas judgment of 22 September 1993, Series A no. 269, para. 29).
