CENTRE FOR LEGAL RESOURCES ON BEHALF OF VALENTIN CÂMPEANU v. ROMANIA
Auszug aus EGMR, 20.09.2016 - 12987/15
The Court has found that the next-of-kin or heir may in principle pursue the application, provided that he or she has sufficient interest in the case (see Centre for Legal Resources on behalf of Valentin Câmpeanu v. Romania [GC], no. 47848/08, § 97, ECHR 2014). - EGMR, 27.03.2008 - 44009/05
SHTUKATUROV v. RUSSIA
Auszug aus EGMR, 20.09.2016 - 12987/15
The interim measure in the present case was therefore also meant to ensure that the applicant could effectively pursue his case before the Court (see Amirov, cited above, § 70, and Shtukaturov v. Russia, no. 44009/05, § 141, ECHR 2008). - EGMR, 08.04.2014 - 73359/10
ERGEZEN c. TURQUIE
Auszug aus EGMR, 20.09.2016 - 12987/15
Whether the rights at issue are transferable to an heir willing to pursue an application on behalf of a deceased person is not therefore a decisive factor (see Fartushin v. Russia, no. 38887/09, §§ 31-34, 8 October 2015 and Ergezen v. Turkey, no. 73359/10, § 29, 8 April 2014). - EGMR, 24.03.2015 - 2959/11
ASSOCIATION FOR THE DEFENCE OF HUMAN RIGHTS IN ROMANIA - HELSINKI COMMITTEE ON …
Auszug aus EGMR, 20.09.2016 - 12987/15
The Court considered that to find otherwise would amount to preventing such serious allegations of a violation of the Convention from being examined at an international level, with the risk that a respondent State might escape accountability under the Convention (see Centre for Legal Resources on behalf of Valentin Câmpeanu, cited above, § 112, and Association for the Defence of Human Rights in Romania - Helsinki Committee on behalf of Ionel Garcea v. Romania, no. 2959/11, § 42, 24 March 2015). - EGMR, 08.10.2015 - 38887/09
FARTUSHIN v. RUSSIA

TARRICONE c. ITALIE
Russie, no 12987/15, §§ 56-57, 20 septembre 2016, et Wenner, précité, § 58). - EGMR, 04.06.2020 - 15343/15
ASSOCIATION INNOCENCE EN DANGER ET ASSOCIATION ENFANCE ET PARTAGE c. FRANCE
Russie, no 12987/15, § 31, 20 septembre 2016). - EGMR, 13.04.2021 - 15593/15
NOVAKOVSKAYA v. RUSSIA
The practice of the Court is to strike applications out of the list when an applicant dies during the course of the proceedings and no heir or close relative wishes to pursue the case (see Hirsi Jamaa and Others v. Italy [GC], no. 27765/09, § 57 with further references, ECHR 2012), save for in very exceptional cases where the Court finds that respect for human rights as defined in the Convention and the Protocols thereto requires a continuation of the examination of the case (see Centre for Legal Resources on behalf of Valentin Câmpeanu v. Romania [GC], no. 47848/08, § 112, ECHR 2014, and Kondrulin v. Russia, no. 12987/15, § 31, 20 September 2016).
