Kokkinakis ./. Griechenland
Auszug aus EGMR, 16.10.2012 - 2158/12
In democratic societies, in which several religions and beliefs coexist within one and the same population, it may be necessary to place restrictions on the freedom to manifest one's religion or belief in order to reconcile the interests of the various groups and to ensure that everyone's beliefs are respected (see Kokkinakis v. Greece, 25 May 1993, § 33, Series A no. 260-A). - EGMR, 06.11.2008 - 58911/00
Rechtssache L. e.V. u.a gegen DEUTSCHLAND
Auszug aus EGMR, 16.10.2012 - 2158/12
On the basis of the considerations set out in the domestic courts" decisions, in particular in the Administrative Jurisdiction Division's ruling of 13 July 2011 (see paragraph 13 above), and reiterating the relevant case-law principles (see, for instance, Leela Förderkreis e.V. and Others v. Germany, no. 58911/00, §§ 86-88 with further references, 6 November 2008), the Court is satisfied that the restriction was "prescribed by law" and pursued the protection of the rights and freedoms of others which is a legitimate aim under Article 9 § 2. - EGMR, 18.02.1999 - 24645/94
Buscarini et al ./. San Marino
Auszug aus EGMR, 16.10.2012 - 2158/12
To determine whether there has been a violation of Article 9 of the Convention, the Court must consider whether the applicant's rights under Article 9 were interfered with and if so, if this interference was "prescribed by law", pursued a legitimate aim and was "necessary in a democratic society" within the meaning of Article 9 § 2 of the Convention (see, among other authorities, Buscarini and Others v. San Marino [GC], no. 24645/94, § 34, ECHR 1999-I). - EGMR, 03.12.2009 - 40010/04
SKUGAR AND OTHERS v. RUSSIA
Auszug aus EGMR, 16.10.2012 - 2158/12
When the actions of individuals do not actually express the belief concerned, they cannot be considered to be as such protected by Article 9 § 1, even when they are motivated or influenced by it (see, Skugar and Others v. Russia (dec.), no. 40010/04, 3 December 2009, with further references).
- EGMR, 06.04.2017 - 10138/11
Negative Religionsfreiheit: Konfessionslose dürfen an Kirchensteuer beteiligt …
Folglich ist der den Vertragsstaaten in dieser Hinsicht zustehende Ermessensspielraum weit gefasst (siehe Schilder./. die Niederlande (Entsch.), Individualbeschwerde Nr. 2158/12, 16. Oktober 2012; Miroļubovs u. a../. Lettland, Individualbeschwerde Nr. 798/05, Rdnr. 80, 15.
