  Notwithstanding the Government's failure to substantiate their allegation, the Court reiterates that by transferring a part of the disputed land to a third party when court proceedings are pending and before the question of ownership had been finally settled by the courts, the State deprived the applicants of any possibility of recovering possession (see, mutatis mutandis, Strain and Others v. Romania, no. 57001/00, §§ 39 and 43, ECHR 2005-VII).
