Or, en l'espèce, la requête n'est pas introduite par une personne morale exerçant des activités commerciales qui seraient soumises au droit commun de la République démocratique du Congo voire par une personne morale de droit public qui ne participerait pas à l'exercice de la puissance publique et qui serait totalement indépendante de l'État (a contrario, Compagnie de navigation de la République islamique d"Iran, précité, §§ 80-81, à comparer avec Ljubljanska banka d.d. c. Croatie (déc.), no 29003/07, §§ 54-55, 12 mai 2015), mais bien par la République démocratique du Congo elle-même.
