  • EGMR, 04.02.2003 - 52750/99

LORSE AND OTHERS v. THE NETHERLANDS

    Auszug aus EGMR, 07.06.2005 - 32768/03
In any event, the mere fact that the applicant was not allowed to have outdoor walks for a definite period of time does not in itself attain the minimum level of severity which is necessary to bring Article 3 into play (cf., mutatis mutandis, Lorsé and Others v. the Netherlands, no. 52750/99, §§ 62-63, 4 February 2003).

  • EGMR, 06.04.2000 - 26772/95

    LABITA c. ITALIE

    Auszug aus EGMR, 28.03.2006 - 32768/03
Continued detention can be justified in a given case only if there are specific indications of a genuine requirement of public interest which, notwithstanding the presumption of innocence, outweighs the rule of respect for individual liberty laid down in Article 5 of the Convention (see, among other authorities, Labita v. Italy [GC], no. 26772/95, §§ 152 et seq., ECHR 2000-IV).
  • EGMR, 19.12.2013 - 56111/12

    ORBAN v. CROATIA

Against the above background, the Court finds that by relying solely on the gravity of the charges when extending the applicant's detention in the period between 21 April 2011 and 9 November 2012, the domestic authorities prolonged the applicant's detention on reasons which cannot be regarded as sufficient (compare Csáky v. Hungary, no. 32768/03, § 36, 28 March 2006; and Pesa, cited above, § 108).
