FAMILLES TAYLOR, CRAMPTON, GIBSON ET KING c. ROYAUME-UNI

    Auszug aus EGMR, 29.03.2001 - 37602/97
If there is no indication that the authorities arbitrarily assessed the evidence before them, the Court must rely on the facts established by those authorities (see no. 20948/92, European Commission HR, decision of 22 May 1995, DR 81, p. 40; cf. also no. 23412/94, decision of 30 August 1994, DR 79-A, pp. 127, 135-137; Valesano v.Italy (dec), no. 42380/98, 31 August 1999).

    ERIKSON v. ITALY

    Auszug aus EGMR, 29.03.2001 - 37602/97
The Court considers that Article 2 of the Convention imposes that, even in cases such as the present one, in which the deprivation of life was not the result of the use of lethal force by agents of the State but where agents of the State potentially bear responsibility for loss of life, the events in question should be subject to an effective investigation or scrutiny which enables the facts to become known to the public and in particular to the relatives of any victims (see Kaya v. Turkey judgment of 19 February 1998, Reports of judgments and decisions for 1998, § 86; Ergi v. Turkey judgment of 18 July 1998, Reports 1998, § 82, and Yasa v. Turkey judgment of 2 September 1998, Reports 1998, §§ 98-100); Erikson v. Italy (dec), no. 37900/97, 26.10.1999).

  • EGMR, 18.10.2012 - 37679/08

    [ENG]

It must concentrate on the purpose of the obligation of effective investigation, which is to secure an effective implementation of the domestic laws which protect the right not to be tortured and, in those cases involving State agents or bodies, to ensure their accountability (see Kelly and Others v. the United Kingdom, no. 30054/96, § 94, 4 May 2001) and to enable the facts to become known to the public (see Sieminska v. Poland (dec.), no. 37602/97, 29 March 2001).
  • EGMR, 16.02.2012 - 23944/04

    [ENG]

The Court reiterates that where a State or its agents potentially bear responsibility for a loss of a life, the events in question should be subject to an effective investigation or scrutiny which enables the facts to become known to the public and in particular to the relatives of any victims (McCann and Others v. the United Kingdom, cited above, § 161; Sieminska v. Poland (dec.), no.37602/97, 29 March 2001; Kaya v. Turkey, cited above, § 86; Ergi v. Turkey, 28 July 1998, §§ 82, Reports 1998-IV, Yasa v. Turkey, cited above, §§ 98-100).

    POCKAJEVS c. LETTONIE

Italie [GC], no 32967/96, §§ 48-49, CEDH 2002-I, et Vo c. France [GC], no 53924/00, §§ 88-89, à paraître dans CEDH 2004, ainsi que Erikson c. BYRZYKOWSKI v. POLAND

In particular, the Court had found no indication in its previous decisions concerning Poland that there had been any failure to provide a mechanism whereby the criminal, disciplinary or civil responsibility of persons who might be held answerable could be established (see, among other authorities, Skraskowski v. Poland (dec), no. 36420/94, 6 April 2000; Sieminska v. Poland (dec.), no. 37602/97, 29 March 2001).
