This view is supported by the decision in the case of Ponsetti and Chesnel v. France (nos. 36855/97 and 41731/98 ECHR 1999-VI, [14.9.99]), relating to separate convictions for two tax offences arising out of the failure to submit a tax declaration, where the respondent Government also argued that this was an example of one act constituting more than one offence.

Das Urteil vom 29. Mai 2001 (Franz Fischer/Österreich, 37950/97) löste anscheinend den Widerspruch zwischen den beiden vorgenannten Rechtssachen auf, indem es auf den Sachverhalt abstellte; das Urteil vom 2. Juli 2002 (Göktan/Frankreich, Rechtssache 33402/96, Reports of Judgements and Decisions 2002-V) griff jedoch wieder auf das rechtliche idem zurück. - EGMR, 27.01.2005 - 73453/01

Dans l'affaire Franz Fischer c. Autriche (no 37950/97, arrêt du 29 mai 2001), elle a conclu que la violation du principe non bis in idem ne pouvait pas être écartée sur le simple constat qu'une personne avait été poursuivie ou punie sur la base de deux infractions nominalement distinctes se fondant sur un seul et même comportement ; encore faut-il examiner si les deux infractions pour lesquelles elle a été poursuivie ne présentent pas en réalité les mêmes éléments essentiels (§ 25).

The applicant argued before the Court that, in the light of the case of Gradinger v. Austria (judgment of 23 October 1995, Series A no. 328-C), the Court of Appeal should quash the decision of the Regional Court.The Government submit that the Court, in its Oliveira v. Switzerland judgment (30 July 1998, Reports of Judgments and Decisions 1998-V), had - contrary to its Gradinger v. Austria judgment (23 October 1995, Series A no. 328-C) - considered the legal qualification as the criterion for determining the "offence" within the meaning of Article 4 of Protocol No. 7. In their view, the present application like the Oliveira case concerns "a typical example of a single act constituting various offences (concours idéal d'infractions)", i.e. a case where one criminal act constitutes two separate offences which does not infringe Article 4 of Protocol No. 7. Besides, unlike the Gradinger case, there was no inconsistency in the two relevant authorities" assessment of the present applicant's blood alcohol level.
