HOKKANEN v. FINLAND
Auszug aus EGMR, 07.09.2017 - 43701/14
It follows from these considerations that the Court's task is not to substitute itself for the domestic authorities in the exercise of their responsibilities for the regulation of the public care of children and the rights of parents whose children have been taken into care, but rather to review under the Convention the decisions taken by those authorities in the exercise of their power of appreciation (see, for example, Hokkanen v. Finland, judgment of 23 September 1994, Series A no. 299-A, p. 20, § 55, and Johansen, cited above, pp. 1003-04, § 64).". - EGMR, 27.11.1992 - 13441/87
OLSSON c. SUÈDE (N° 2)
Auszug aus EGMR, 07.09.2017 - 43701/14
Moreover, it must be borne in mind that the national authorities have the benefit of direct contact with all the persons concerned (see Olsson v. Sweden (no. 2), judgment of 27 November 1992, Series A no. 250, pp. - EGMR, 13.03.2012 - 4547/10

As to the procedural requirements under Article 8 of the Convention, the Court held, for instance, in Y.C. v. the United Kingdom, no. 4547/10, § 138, 13 March 2012:. - EGMR, 22.10.2015 - 10592/12
JOVANOVIC v. SWEDEN
Auszug aus EGMR, 07.09.2017 - 43701/14
The Court reiterates that it is the master of the characterisation to be given in law to the facts of the case, and that it has previously held that while Article 8 of the Convention contains no explicit procedural requirements, the decision-making process leading to measures of interference must be fair and such as to afford due respect to the interests safeguarded by Article 8. It considers that the complaint raised by the applicant under Article 6 of the Convention is closely linked to her complaint under Article 8 and may accordingly be examined as part of the latter complaint (see, for example, Jovanovic v. Sweden, no. 10592/12, § 53, 22 October 2015).

KiLiC v. AUSTRIA
Another aspect the Court will look at is whether the domestic courts conducted an in-depth examination of the entire family situation (see Y.C. v. the United Kingdom, no. 4547/10, § 138, 13 March 2012 and, more recently, M.L. v. Norway, no. 43701/14, § 42, 7 September 2017). - EGMR, 24.06.2025 - 61347/21
D.G. AND S.G. v. SERBIA
Rn. 183 In that connection, the Court reiterates that the domestic authorities are required to conduct an in-depth examination of the entire family situation (see Y.C. v. the United Kingdom, no. 4547/10, § 138, 13 March 2012, and M.L. v. Norway, no. 43701/14, § 42, 7 September 2017).
