Rn. 21 The Court reiterates that the "reasonableness" of the length of proceedings must be assessed in the light of the circumstances of the case and with reference to the following criteria: the complexity of the case, the conduct of the applicant and the relevant authorities, and what was at stake for the applicant in the dispute (see, among many other authorities, Pélissier and Sassi v. France [GC], no. 25444/94, § 67, ECHR 1999-II, and Frydlender v. France [GC], no. 30979/96, § 43, ECHR 2000-VII). - EGMR, 27.06.2000 - 30979/96

SCHRADE v. GEORGIA
Auszug aus EGMR, 11.07.2024 - 4639/23
As for the disciplinary action, the argument regarding its effectiveness was previously examined and dismissed by the Court in the case of Schrade v. Georgia ([Committee], no. 15016/07, §§ 41-42, 11 March 2021).

A 3322/20 -, juris; VG Berlin, Urteil vom 26.02.2024 - 34 K 5/23 A -, juris; ferner - n.v. -: VG Hamburg, Urteil vom 14.02.2024 - 14 A 4639/23 - VG Hannover, Urteil vom 27.02.2024 - 13 A 1223/23 - VG Berlin, Urteil vom 27.02.2024 - VG 34 K 319/23 A - VG Meiningen, Urteil vom 29.02.2024 - 2 K 1072/22 Me - ähnlich auch VG Kassel, Urteil vom 11.03.2024 - 5 K 612/23.KS.A - VG Göttingen, Gerichtsbescheid vom 20.03.2024 - 1 A 47/23 - VG Freiburg, Urteil vom 22.03.2024 - A 10 K 460/24 - Schleswig-Holsteinisches VG, Urteil vom 17.05.2024 - 15 A 193/22 -, juris; VG Potsdam, Urteil vom 24.05.2024 - VG 11 K 1204/24.A - VG Dresden, Urteil vom 03.06.2024 - 11 K 1287/22.A - VG Darmstadt, Urteil vom 01.07.2024 - 6 K 1257/22.DA.A -, juris; VG Bayreuth, Urteil vom 31.07.2024 - B 3 K 24.31139 -, juris; VG Stuttgart, Urteil vom 24.09.2024 - A 7 K 4112/24 -, juris).Auch die Regelung in § 24 Abs. 5 AsylG und die Vorgaben des Art. 31 Abs. 4 der Asylverfahrensrichtlinie ändern daran nichts (vgl. dazu OVG Sachsen-Anhalt, Beschluss vom 20.11.2023 - 3 L 82/23.Z -, juris, m.w.N.; VG Hamburg, Urteil vom 14.11.2023 - 14 A 3322/20 -, juris; Urteil vom 14.02.2024 - 14 A 4639/23 -, n.v.; VG Hannover, Urteil vom 27.02.2024 - 13 A 1223/23 -, n.v.; VG Berlin, Urteil vom 27.02.2024 - VG 34 K 319/23 A -, n.v.; VG Meiningen, Urteil vom 29.02.2024 - 2 K 1072/22 Me -, n.v.; VG Kassel, Urteil vom 11.03.2024 - 5 K 612/23.KS.A -, n.v.; VG Göttingen, Gerichtsbescheid vom 20.03.2024 - 1 A 47/23 -, n.v.; VG Freiburg, Urteil vom 22.03.2024 - A 10 K 460/24 -, n.v.; VG Hamburg, Gerichtsbescheid vom 03.06.2024 - 14 A 789/24 -, juris; ferner: Raad van State, uitspraak vom 24.04.2024 - ECLI:NL:RVS:2024:1663 -).
- EGMR, 08.09.2026 - 31727/23
NADASHVILI v. GEORGIA
In those circumstances, and having regard to the absence of any effective domestic remedy in this regard (see, among other authorities, Schrade v. Georgia [Committee], no. 15016/07, §§ 41-42, 11 March 2021, and I.B. v. Georgia [Committee], no. 4639/23, § 18, 11 July 2024), the Court does not consider it unreasonable that the applicant waited for two years before lodging the present application (see, for example, Omarov v. Georgia [Committee], no. 25967/23, § 8, 7 April 2026, with further references).
- EGMR, 09.12.2025 - 24060/23
TORDIA AND OTHERS v. GEORGIA
The Court further refers to its consistent case-law concerning the lack of a specific preventive remedy capable of expediting proceedings in the Georgian legal system and the absence of a compensatory remedy (see Schrade v. Georgia [Committee], no. 15016/07, §§ 41-42, 11 March 2021, and I.B. v. Georgia [Committee], no. 4639/23, § 18, 11 July 2024). - EGMR, 11.02.2025 - 45681/22
ZAALISHVILI v. GEORGIA
In the absence of effective domestic remedies (see, for illustrative purposes, Schrade v. Georgia [Committee], no. 15016/07, §§ 41-42, 11 March 2021; Kadzanaia v. Georgia [Committee], no. 27178/21, §§ 9-12, 21 March 2024; Mgeladze v. Georgia [Committee], no. 35413/19, §§ 8-10, 16 May 2024; and I.B. v. Georgia [Committee], 4639/23, §§ 18-19, 11 July 2024) and while noting that the applicant does not appear to have had enquired, at least in written form, about the progress of the cassation proceedings for over five years, the Court sees no grounds on which to absolve the State of its responsibility for the stagnation of the proceedings before the Supreme Court. - EGMR, 07.04.2026 - 25967/23
OMAROV v. GEORGIA
It cannot, therefore, be said that the applicant suffered no significant disadvantage on account of the delay in obtaining the award in question (see I.B. v. Georgia [Committee], no. 4639/23, § 19, 11 July 2024).
