Die Liste wurde denn auch nach der Verkündung des Urteils vom 29. September 1998, Canon (C-39/97, EU:C:1998:442), durch das Hinzufügen weiterer Kriterien ergänzt (Urteil vom 21. Juli 2016, 0grodnik/EUIPO - Aviário Tropical [Tropical], T-804/14, nicht veröffentlicht, EU:T:2016:431, Rn. 58), etwa das der üblichen Herkunft der betreffenden Waren (…Urteile vom 26. September 2017, Banca Monte dei Paschi di Siena und Banca Widiba/EUIPO - ING-DIBa [WIDIBA], T-83/16, nicht veröffentlicht, EU:T:2017:662, Rn. 64, …und vom 13. November 2018, Camomilla/EUIPO - CMT [CAMOMILLA], T-44/17, nicht veröffentlicht, EU:T:2018:775, Rn. 76 und 91) und, wie oben in Rn. 44 angeführt, das der Vertriebswege der betreffenden Waren.

Rn. 62 Folglich ist festzustellen, dass die Beschwerdekammer dadurch, dass sie nicht angegeben hat, aus welchen Gründen die Kriterien der üblichen Herkunft oder sogar der Identität der Hersteller sowie der Identität der Vertriebswege nicht berücksichtigt wurden, nicht alle Tatsachen und rechtlichen Erwägungen angeführt hat, die für die Verneinung der Warenähnlichkeit von wesentlicher Bedeutung sind, so dass die angefochtene Entscheidung mit einem Begründungsmangel behaftet ist (vgl. in diesem Sinne Urteil vom 21. Juli 2016, Tropical, T-804/14, nicht veröffentlicht, EU:T:2016:431, Rn. 178).

'As a preliminary point, it should be recalled that, in its judgment of 21 July 2016, Tropical (T-804/14, not published, EU:T:2016:431, paragraphs 34 and 45), the Court held that "food in the form of flakes, granulates, grains, extrudates and tablets, dried and lyophilised natural food for fauna, especially for fish, ornamental fish, birds, reptiles, amphibians and breeded small animals", "food for fauna containing nutritives", and "products and preparations for the breeding of fish, ornamental fish and breeded small animals" in Class 31, covered by the contested mark, were identical to "food for fish" covered by the earlier mark.'.
