INFORMATIONSVEREIN LENTIA AND OTHERS v. AUSTRIA

    Auszug aus EGMR, 11.07.2000 - 38218/97
The Contracting States' margin of appreciation in this area involves strict supervision because of the importance of the right to freedom of expression (see Informationsverein Lentia and Others v. Austria judgment of 24 November 1993, Series A no. 276, p. 15 § 35).

The Court notes in this respect that the present case is to be distinguished from the case of Informationsverein Lentia and Others v. Austria judgment of 24 November 1993 (Series A no. 276) where there was a monopoly of all broadcasting and radio stations held by the State.

    AUTRONIC AG v. SWITZERLAND

    Auszug aus EGMR, 11.07.2000 - 38218/97
Further the necessity for any restriction must be convincingly established (see Autronic AG v. Switzerland judgment of 22 May 1990, Series A no. 178, p. 26 § 61).

GROPPERA RADIO AG ET AUTRES c. SUISSE

    Auszug aus EGMR, 11.07.2000 - 38218/97
The Court notes the third sentence of Article 10 § 1 of the Convention, and recalls that States are permitted to control, by a licensing system, the way in which broadcasting is organised in their territories, but that licensing measures must comply with the requirements of Article 10 § 2 (see Groppera Radio AG and Others v. Switzerland judgment of 20 June 1989, Series A no. 173, p. 24 § 61).
  • EGMR, 17.06.2008 - 32283/04

MELTEX LTD AND MOVSESYAN v. ARMENIA

Such refusals constituted interferences with the applicant company's freedom to impart information and ideas (see Grauso v. Poland, no. 27388/05, Commission decision of 9 April 1997, unreported; and also, mutatis mutandis, Verein Alternatives Lokalradio Bern and Verein Radio Dreyeckland Basel v. Switzerland, no. 10746/84, Commission decision of 16 October 1986, Decisions and Reports (DR) 49, p. 126; Informationsverein Lentia and Others v. Austria, judgment of 24 November 1993, Series A no. 276, p. 13, § 27; Radio ABC v. Austria, judgment of 20 October 1997, Reports of Judgments and Decisions 1997-VI, p. 2197, § 27; Brook v. the United Kingdom (dec.), no. 38218/97, 11 July 2000; United Christian Broadcasters Ltd v. the United Kingdom (dec.), no. 44802/98, 7 November 2000; and Demuth v. Switzerland, no. 38743/97, § 30, ECHR 2002-IX).
