GORZELIK AND OTHERS v. POLAND
Auszug aus EGMR, 12.01.2023 - 27276/15
The interpretation and application of such enactments depend on practice (see Gorzelik and Others v. Poland [GC], no. 44158/98, § 64, ECHR 2004-I). - EGMR, 10.02.1983 - 7299/75
ALBERT ET LE COMPTE c. BELGIQUE
Auszug aus EGMR, 12.01.2023 - 27276/15
According to the Court's case-law, even where an adjudicatory body determining disputes over "civil rights and obligations" does not comply with Article 6 § 1 in some respect, no violation of the Convention can be found if the proceedings before that body are "subject to subsequent control by a judicial body that has full jurisdiction and does provide the guarantees of Article 6 § 1" (see Albert and Le Compte v. Belgium, 10 February 1983, § 29, Series A no. 58, and Tsfayo v. the United Kingdom, no. 60860/00, § 42, 14 November 2006). - EGMR, 19.12.1994 - 15153/89
VEREINIGUNG DEMOKRATISCHER SOLDATEN ÖSTERREICHS AND GUBI v. AUSTRIA
Auszug aus EGMR, 12.01.2023 - 27276/15
It may therefore be necessary for the authorities to formulate such rules more broadly (see Vereinigung demokratischer Soldaten Österreichs and Gubi v. Austria, 19 December 1994, § 31, Series A no. 302).

MARKUSH v. UKRAINE
By the same resolution, Parliament also dismissed the Constitutional Court's judges who had been appointed under Parliament's quota (see Ovcharenko and Kolos v. Ukraine, nos. 27276/15 and 33692/15, §§ 16-20, 12 January 2023, and Golovin v. Ukraine, no. 47052/18, § 6, 13 July 2023).Was the applicant's right to fair trial under Article 6 of the Convention infringed? In particular, has there been a violation of the applicant's right to a reasoned judgment as guaranteed by Article 6 § 1 of the Convention (see Ovcharenko and Kolos v. Ukraine, nos. 27276/15 and 33692/15, §§ 120-27, 12 January 2023, and Golovin v. Ukraine, no. 47052/18, §§ 32-36, 13 July 2023)?.
Has there been an interference with the applicant's right to respect for her private life within the meaning of Article 8 of the Convention? If so, was that interference in accordance with the law (see Ovcharenko and Kolos v. Ukraine, nos. 27276/15 and 33692/15, §§ 93-110, 12 January 2023, and Golovin v. Ukraine, no. 47052/18, §§ 23-31, 13 July 2023)?.

GYULUMYAN AND OTHERS v. ARMENIA
For that reason, the intervention of any ordinary courts was likewise inconceivable (contrast Ovcharenko and Kolos v. Ukraine, nos. 27276/15 and 33692/15, 12 January 2023, concerning the dismissal of individual Constitutional Court judges for a disciplinary offence which was open to challenge in the courts).
